1) The permittee is required to contact Local Permit Officer shortly before he plans to begin construction to arrange a setback measurement which will be effective &
sixty (60) days barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is void and must be redo
1) Any structure within the Ocean Hazard AEC sh 4 be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The
structure(s) shalt be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence.
However, if natural shoreline recovery or beach Renourishnent takes place within two years of the time the structure becomes imminently threatened so that the
structure is no longer imminently threatened, then it natal not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek
authorization of temporary protective measures allowed under the Coastal Resources Commission Rules.
3) In order to avoid unreasonable danger to life and property, all development shall be designed and placed so as to minimize damage due to fluctuations in ground
elevation and wave action in a 100 year storm. Cantilevered decks and walkways shall meet this standard or shall be designed to break -away without structural dam
to the main structure. Any building constructed within the ocean hazard area shall comply with the North Carolina Building Code including the Coastal and Flood
Construction Standards, Chapter 34, Volume I or Section 39, Volume i- 3 and the local flood damage prevention ordinance as required by the National Flood Insure
Program. if any provisions of the building code or a flood damage prevention ordinance is inconsistent with any of the AEC standards, the more restrictive provision
shalt control.
4) The structure must be set back 60 feet from the first line of stable, natural vegetation. Decidng not to exceed 500 square feet total.
5) The structure must be located entirely off the frontal dune, and, if a primary dune is present, behind the crest of the primary dune.
6) The structure must be elevated on pilings with a diameter of at least eight (8) inches and the first floor level of the sills and joists must rrtect the minimal t00 year
flood as required by FIRM Community Panel + J.
7) All pilings shall have a tip penetration of at least five (5) feet below mean sea level, or sixteen (16) feet below average original grade, whichever is least; if locate
a primary dune, the tip penetration must be at !cast five (5) feet below mean sea level.
8) No impermeable surfaces shall be allowed over any functional pan of the septic tank system.
9) Dune disturbances will be allowed only to the extent necessary for development, and if the dune's protective value is not weakened or reduced. Disturbed areas wy
be immediately stabilized.
10) This pennit may be renewed for one year, j re�ursied before the evnlrarfon date,
i i) Sand used to strengthen dunes must be brought in from an outside source and must be ofthe same nature as the sand in
the area in which it is to be placed &dUt 4ional permit required from district office.

12) Sand held in storage in any dune other than frontal or primary dunes may be moved laterally in order to strengthen existing primary or frontal dunes if the work
would enhance the protection to the proposed development activity and the sand is immediately stabilized.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the Issuing date.
From the date of an appeal, any work conducted under this per-
mit most cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alteration aredesigned tominimmize,but
not eliminate, property loss from hazards. By ranting
permits, the Coastal Resources CommissionnSloes not
guarantee the safety of the development and assumes no
liability for future.damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
e son rate for the area where your property is located is
feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies aL indicate that the shoreline could move as
much asfeet landward in a major storm.
Th flood waters in a major storm are predicted to be about
feet deep in this area.
Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited, Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued fordevelopment in this
area expire on December 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will.
determine the vegetation line and setback distance at your
site. If thepropertyhas seen little change and the proposed
development can still meet the setback requirement, the
LPO will inform you that }rou may begin work. It is impor
tant that you check wi th the LPO before the permit expires
for official approval to continue the work after the permit
has expired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary; If substantial progress has
not been made, the permit must be renewed and a netiv
setback h e`established.It is unlawful to continue work
after permit expiration without this approval.

CAMA PERMIT NOTICE
Pursuant to NCGS 113A-I 19(b), Emerald Isle, a locality authorized to issue
permits in Areas of Environmental Concern, through the Coastal Area
Management Agency (CAMA), hereby gives NOTICE that on October 1, 2004,
Adam Lucas applied for a Minor CAMA Permit to erect a pool and a roof over
existing deck within the Area of Environmental Concern, at 10 109 Sea Breeze
Dr., Block 49, Lot 194.
The application may be inspected at the address below. Public comments
received by October 15, 2004 will be considered. Later comments will be
