permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The permittee is required to contact Local Permit Officer shortly before he plans to begin construction to arrange a.setback measurement which will be effective f r
sixty (66) days barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is void and must be redo .
2) Any structure within the Ocean Hazard AEC shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The
structure(s) shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence.
However, if natural shoreline recovery or beach Renourishment takes place within two years of the time the structure becomes imminently threatened so that the
structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek
authorization of temporary protective measures allowed under the Coastal Resources Commission Rules.
3) In order to avoid unreasonable danger to life and,nroperty, all development shall be designed and placed so as to minimize damage due to fluctuations in ground
elevation and wave action in a 100year storm. Cantilevered decks and walkways shall meet this standard or shall be designed to break -away;' without structural dam ge
to the main structure. Any building constructed within the ocean hazard area shall comply with the North Carolina Building Code including the Coastal and Flood I lain
Construction Standards, Chapter 34, Volume I or Section39, Volume I-B and the local flood damage prevention ordinance as required by the National Flood Insura ice
Program. if any provisions of the building code or a flood damage prevention ordinance is inconsistent with any of the AEC standards; the more restrictive provisio
shall control.
4) The structure must be set back 60 feet from the first line of stable, natural vegetation. Decking not to exceed 500 square feet total.
5) The structure must be located entirely off the frontal dune, and, if a primary dune is present, behind the crest of the primary dune.
6) The structure must be elevated on pilings with a diameter of at least eight (8) inches and the first floor level of the sills and joists must meet the minimal 100 year
flood as required by FIRM Community Panel 370047-000 D.
7) All pilings shall have a tip penetration of at least five (5) feet below mean sea level, or sixteen (16) feet below average original grade, whichever is least; if locate I on
a primary dune, the tip penetration must be at least five (5) feet below mean sea level.
8) No impermeable surfaces shall be allowed over any functional part of the septic tank system.
9) Dune disturbances will be allowed only to the extent necessary for development, and if the dune's protective value is not weakened or reduced: Disturbed areas w 11
be immediately stabilized.
10) This permit may be renewed for one year, if reguested before the expiration date.

12) Sand held in storage in any dune other than frontal or primary dunes may be moved laterally in order to strengthen existing primary or frontal dunes if the wor

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal,any work conducted under this per-
mit m,.st cease until the appeal is resolved.

ACCESS OVER THE DUNE AS A PART OF MINOR PERMIT:
Accessways shall be exclusively for pedestrian use, shall be no more than six(6) feet wide, and shall be elevated on pilings
of no more than five (5) feet in depth so that only the pilings touch the sand.
2. Only negligible alteration of dunes is allowed during construction and any disturbed areas of vegetation shall be revegetated
immediately.
3. Unenclosed, uninhabitable gazebos with floor areas of 200 square feet or less, are permitted.

The Minor CAMA Permit application that was submitted on January 21, 2004 has had to be put on
HOLD in order to determine the delineation of the placement of the `first stable line of vegetation'.
As you know there is a deep cut on the oceanward portion of this property with vegetation that follows
the contour of the of this cut. I have asked that Ms. Terre Barrett, CAMA Field Representative from
the Morehead City office make a site visit with me to make this determination.
Once Ms. Barrett and I have made this decision, the permit will once again process in the normal
manner and be permitted.

CAMA PERMIT NOTICE
Pursuant to NCGS 113A-119(b), Emerald Isle, a locality authorized to issue .
permits in Areas of Environmental Concern, through the Coastal Area
Management Agency (CAMA), hereby gives NOTICE that an January 21, 2004,
Wm R Campbell, R 0 Watson and Stephen E Matthews submitted a CAMA
Minor Permit application to erect a 3-story single family dwelling, with 4
bedrooms, concrete drive, septic, beach access, sitting area, and pool at 113 Janell
Lane, Block 41, Lot 2, Seawatch S/D, Emerald Isle, NC
The application may be inspected at the address below. Public comments
received by February 6, 2004 will be considered. Later comments will be
accepted and considered up to the time of permit decision. Project modifications
may occur based on further review and comments. Notice of the permit decision

This notice is intended to make y , the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules onbuilding standards, oceanfront
setbacks and dune alteration are designed to minimize,but
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
erosion rate for the area where your property is located is
I_ feet per year. .
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as
much as feet landward in a major storm.
Thellood watersin amajor storm arepredicted tobe about
feet deep in this area.
Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sandbags, may
be allowed under certain conditions.

requirements by signing this notice in the below space.
Without the proper signature, the application will not be
