Issued to Atlantis L o d o e . Inc . , authorizing development in Pine Knoll Shores at— 123 Salter Path Road as requested in the permittee's application, dated 10 / 5 / 04 This permit, issued on 11 /01 /U4 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of those terms may subject pormittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. P.01 ermit Number This permit authorizes Atlantis Lodgc, Inc. Any other development will require additional permits or a modification of Ibis permit. The following conditions shall apply: 1) Ali proposed development and associated construction must be done in accordance with the application dazed October 5, 2004. 2) Pursuant to 15A NCAC 07j.0406(b), this permit may not be assigned, transferred, sold, or otherwise disposed of to a third party by the applicants agent, or any entity other than the NC Division of Coastal Mamgement. 3) The stricture shall comply with the NC Building Code and all other Federal, State, and Local teguladons, including the National Flood Insurtace Program 4) No impermeable surfaces shall be allowed over any functional part of the septic tank system 5) Dune disturbances shall be allowed only to the extent necessary for development and N the dunc's protective valve is not weakened or reduced. Disturbed arras will be immediately stabli'lized vegctauivcly_ No development shall involve the significant relocation or removal of primary or iiordal dune sand or vegetation thereon. 6) Sand used to strengthen dimes must be brought in from an outside source and must be of the same nature as the sand in the area in which it is to be placed, No sand is to be removed from the lot. 7) Adding to dunes shall be accomplished in such a manner that the damage to existing vegetation is minimized The filled areas will be immediately stabilized vegetatively. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit mist cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project Is Inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All work must cease when this permit expires on December 31, 2007 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. This permit may not be transferred to another party without the written approval of the Division of Coastal Management.
