Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This modification authorizes the extension of the previously permitted retaining wall in an easterly direction. All original conditions remain effective. The authorization is contingent upon the following additional conditions: 1. A representative of Coastal Management must stake the proposed retaining wall extension prior to construction. This established alignment will be effective for 90 days, after this date a new alignment must be staked. 2. The proposed retaining wall should be landward of all 404 and Coastal Wetlands. 3. The grading and filling of the authorized wall must not increase stormwater flow to the adjacent waters. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit mist cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All work must cease when this permit expires on December 31 2003 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances.
