This permit, issued on January 31, 2003 . is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
To construct a three bedroom, single family dwelling, 1600 square foot, and a
168 square foo porch with a 300 square foot shed within 75' of the AEC. All
development is to be at least 30' landward of the NHW level of Broad Creek,
Newport, North Carolina.
Prior to initiating land —disturbing activities, adequate sedimentation/erosion contro
measures must be employed to prevent the movement of unconsolidated materials into
the marsh or water. These measures must remain in place until such time as the area
is properly stabilized with vegetated cover.
The development authorized under this permit must be accomplished a minimum of
30' landward of the normal high water contour/normal water contour, maintaining this
as a vegetated buffer area.
The permitted activity should not impede ingress or egress through the referenced
easement labeled on the January 21, 2003 plat. This easement was confirmed through
District Court case 81—CVD_369 on the 22nd of April, 1982. The amount of
impervious surface area shall not exceed 30% of the lot area within the 75' of the
AEC (area of environmental concern).
All proposed development and associated construction must be done in accordance with
the revised workplat drawing as submitted on January 21, 2003. All construction
must conform to the North Carolina Building Code Requirements and all other state
and federal regulations. Any change or changes in the plans for development,
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit m.st cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.

This correspondence is in reference to your January 16, 2003 "notice of disagreement"
letter to the recent project proposal by your adjacent riparian property owner, Mr. Robert
M. Lawrence. The proposal involved the construction of single-family residence and
shop area situated at least 30' landward of the normal high water level of Broad Creek
located at 3238 Highway 24, in Newport, Carteret County.
The Carteret County Inspections Office has given your objections careful consideration
and has determined that the project is consistent with the pertinent regulations of the
Division of Coastal Management. Therefore, on January 31, 2003, the Carteret County
Inspections Office, acting as Local Permit Officer for the Division of Coastal
Management, issued CAMA Minor Permit No. 082-02 to Mr. Robert M. Lawrence for
the aforementioned work.
If you wish to appeal this permit decision, you may file a request with the Director of the
Division of Coastal Management, Department of Environment and Natural Resources
within 20 days of the permit decision. I have enclosed a copy of the CAMA Minor

Larry and Kathy,
I would recommend a few clarification points since there has been this "notice of
disagreement". The draft looks great and I believe acceptable but since we do have an
objector I think it should include a few clarifications since we could face an appeal.
The opening paragraph should imply that all development is at least 30' landward of the
NHW level not at the 30' level. One could think this gives him authorization to place the
residence at the 30' mark when he has applied for it to be greater than 40' landward of the
NHW level.
I would include General Coastal Shoreline Conditions; #5 and # 12. These were the updated,
conditions given at the LPO workshop, I believe Katrina picked these up for your office. If
you are having a hard time finding them let me know.
Lastly, I would include a condition that says, " The permitted activity should not impede
ingress or egress through the referenced easement labeled on the January 21, 2003 plat. This
easement was confirmed through District Court case 81-CVD-369 on the 22°d of April,
1982."
Everything else looks great! Larry, make sure to include the minor permit number in the
letter to Mr. White and a signed copy of the minor permit by both you and Mr. Lawrence as
an attachment to the override objection letter.

said roadway is now being used by plaintiffs and defendants as
i
means of ingress and egress from Highway A24 to Broad Creek.
S. That said deeds stipulated into evidence and the map
stipulated into evidence reveal that the area of said road 24
feet in width which crosses the property claimed by the plaintiffs
is in fact not owned by the plaintiffs but is owned by the heirs
of J. W. Pearson et al and was intended for use as a roadway by
the said J. 14. Pearson et al when the tract of land originally
was developed by J. W. Pearson and conveyed out in separate tracts.
BASED upon said findings of fact the court does make the
following CONCLUSIONS OF LAW:
1. That the parties are properly before the court and
the court has jurisdiction over this cause.
2. That the area of land 24 feet in width extending from
the northern margin of Highway ff24 to Broad Creek is a roadway for
the purpose of iry ress and egress to property owned by the plain-
tiffs and the defendants and the plaintiffs have no standing to
demand injunctive relief to prevent the defendants from using said
roadway and crossing the same from N. C. Highway #24 to Broad
Creek.
IT IS NOW, THEREFORE. ORDERED, ADJUDGED and DECREED that
the defendants' motion to dismiss the plaintiffs' complaint is
hereby allowed and the plaintiffs' claim is dismissed.
Upon the court's announcement of its judgment of•dismissal
against the plaintiffs in this cause the defendants announced in
open court prior to judgment that they were submitting to voluntary
dismissal of their counterclaim without prejudice and, therefore,

title to to said tract of land b;: conveyance from her ex-husband,
R. E. Patterson, which deed is recorded in Book 433, page 303.
Carteret County Registry, and prior to said conveyance the said
Diane Patterson Glosson, who was formerly Diane Patterson, acquired
title to said premises by deed dated ?Iovember 3. 1977 of record
in Book 404, pa;;e 400. Carteret County Registry, which was executed
hv F. C. Barefoot and wife.
3. The defendants acquired title to the lands they
allege to,own as described in their answer and counterclaim by
deed from Eden C. Barefoot dated April 4, 1980 of record in Rook
439. pa4e 82, Carteret County Registry. That E. C. Barefoot and wife
is the coon grantor of both plaintiffs and defendants.
4. The lands described in the plaintiffs' deed includes
a strip of land which crosses the same 24 feet in width which was
described as a roadway by the original developer of said property,
to :.it: 1. ':. Pearson, et al, who owned at one time the entire
tract now owned by tie plaintiffs and the defendants. That when
J. W. ?earson et al conveyed said premises to the predecessors in
title to E. C. Barefoot and wife, he made reference in said deeds
to a roadway 24 feet in width extending from N.C. Highway #24 to
Broad Creek across property now owned by the plaintiffs and the
defendants. That the map introduced into evidence by the plaintiffs
reveals sai(! roar!wa_: and the parries by stipulation have acknow-
leJ;-ed the existence of said roadway. That the parties have further
stipulated into evidence all of the deeds hereinabove referred to.
That said roadway is 24 feet in width and does in fact extend from
the northern margin of N.C. Highway !Q4 to Rroad Creek as calle:i
for in those deeds of record in Book 136. page 489; Book 142,

Notice of Disagreement
This property has a 24 foot roadway that divides the property in half. The property overall is 180 feet
wide by 121 deep and when you subtract the 24 foot roadway that leaves the lot size he wishes to build
on —75 by 121, then you must take the required set backs which further reduces the building area .
According to NCDENRA dtd. August 15, 2000 para 15a ncac 18 ( a) Location of Sanitary Sewage
Systems states in sub para (a)-1 Sewage 100 feet from private water source, (a)6 from streams, canal
marsh, or other surface waters.
So within this confine of less than 75 by 121 feet a well must be 100 feet from any septic and drain field,
25 feet from any building foundation and 50 feet from any surface water. Drain and water lines cannot be
under the road.
When I built the restaurant, apartments, and my own home I was required to abide by the State and
County rules and regulations and I feel very strongly that all others do the same.
I have no objections to him building a house as long as he meets all State and County Rules and
Regulations . The road will remain as it is by the Court Order.
The sketch does not represent a true dividing line for the road . The foundation will
only be a few feet from the road.

in an area of environmental concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management."

as requested in the permittee's application, dated December 31, 2002
This permit, issued on January 31, 2003 , is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
To construct a three bedroom, single family dwelling, 1600 square foot, and a
168 square foo porch with a 300 square foot shed within 75' of the AEC. All
development is to be at least 30' landward of the NHW level of Broad Creek,
Newport, North Carolina.
Prior to initiating land —disturbing activities, adequate sedimentation/erosion contro
measures must be employed to prevent the movement of unconsolidated materials into
the marsh or water. These measures must remain in place until such time as the area
is properly stabilized with vegetated cover.
The development authorized under this permit must be accomplished a minimum of
30' landward of the normal high water contour/normal water contour, maintaining this
as a vegetated buffer area.
The permitted activity should not impede ingress or egress through the referenced
easement labeled on the January 21, 2003 plat. This easement was confirmed through
District Court case 81—CVD_369 on the 22nd of April, 1982. The amount of
impervious surface area shall not exceed 30% of the lot area within the 75' of the
AEC (area of environmental concern).
All proposed development and associated construction must be done in accordance with
the revised workplat drawing as submitted on January 21, 2003. All construction
must conform to the North Carolina Building Code Requirements and all other state
and federal regulations. Any change or changes in the plans for development,
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit m.st cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All wok must cease when this permit expires on December

with the local Land Use Plan and all applicable ordinances.
