All proposed development and associated construction must be done in
accordance with the permitted workplat drawing (s) as originally submitted.
Any change or changes in the plans for development, construction, or land use
activities will require a re-evaluation and modification of this permit.
In order to prevent sedimentation, a vegetated buffer zone must be maintained
between all disturbed area and the adjacent waterbody or marsh.
Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked
hay bales, or burlap must be installed between the land -disturbing activity and the
adjacent marsh or water areas, until such time as the area has been properly
stabilized with a vegetated cover. -
Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned,
transferred, sold or otherwise disposed of to a third -party.
The area proposed for grading within the 30' buffer from the normal high water
contour/normal water contour must immediately be vegetatively stabilized, and
must remain in a vegetated state.
No excavation or filling of any wetlands or waters is authorized under this permit.
Property to be graded within the 30' buffer must allow all water run-off to the
inland side of property. No water run-off is permitted to the waterway.
A copy of this permit shall be available onsite for regulatory inspection.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit mist cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.

In issuing this permit it is agreed that this project is consistent
with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

Pursuant to NCGS I I3A-119(b), Morehead City, a locality authorized to issue CAMA permits in
Areas of Environmental Concern, hereby gives NOTICE that on July 25, 2003, Roy Kittrell Jr.
applied for a CAMA minor permit to fill, grade and landscape his property located at 1400Dills
Creek Lane, Morehead City, NC.
The application may be reviewed at the Inspections and Planning Office, 706 Arendell Street,
Morehead City, NC, during normal business hours. If you have questions you may phone (252)

I acknowledge that the land owner is aware that the proposed development is planned for an area which may be susceptible to
erosion and/or flooding. I acknowledge that the local permit officer has explained to me the particular hazard problems associ-
ated with this lot. This explanation was accompanied by recommendations concerning stabilization and floodproofing tech-
niques.
PERMISSION TO ENTER ON LAND:
I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer and his agents to

Dear Mr. Kittrell:
This letter confirms that I was at 1400 pills Creek Lane, Lot # 103 Blair
Farm IV Subdivision, Morehead City in Carteret County, North Carolina on
July 8, 2003 to investigate the possibility of development in an Area of
Environmental Concern (AEC) without proper authorization. My visit verified that
fill had been placed on the lot within the Coastal Area Management Act (CAMA),
estuarine shoreline AEC. No Minor Development Permit has been issued forthis
development activity.
No person may undertake activity constituting minor development within a
designated Area of Environmental Concern without first obtaining a Minor
Development Permit from the North Carolina Department of Environment and
Natural Resources or a Local Government with an approved Coastal Area
Management Implementation and Enforcement Program. This requirement is
imposed by North Carolina General Statutes (NCGS) 11 3A-1 18.
You are hereby requested to STOP WORK IMMEDIATELY and contact
this office by July 16, 2003 to file the necessary application. NO WORK MAY
PROCEED UNTIL THE PF_RMIT IS ISSUED. If you comply voluntarily, no
further action will be necessary beyond restoration of any damaged natural
resources protected by the Act, whatever project modifications are needed to
bring your development into compliance with the Act and the issuance of a
permit.
