This permit, issued on 8/21/03 is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This Is a permit authorizing the construction of a single family dwelling and a 6' x 14' front porch 30' landward of the high
water mark located at 540 N. Ignston Ave. Any other development will require additional permits or a modification of this
permit The following conditions shall apply:
All proposed development and associated construction must be done in accordance with the permitted workplat drawing and the
engineered stormwater plan as revised, stamped and received on August 21, 2003. This permit also authorizes the construction of
an 8' x 14' covered porch on the canal side of the house as long as the proposed house is moved eight feet towards the road as
noted on the revised survey as submitted, stamped and received on August 21, 2003. This permit does not authorize any land
disturbing activity within the 30' buffer.
All construction must conform to the N.C. Building Code requirements and all other Local, State and Federal regulations.
Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification
of this permit
The applicant has effectively demonstrated, through an engineered, innovative construction design done by John P. McLean, P.E.,
that the amount of impervious surface area may be exceeded in a way that runoff water will be managed to a similar degree as
limiting the coverage to 30%. This design allows for 1,545 sq. ft of impervious surface area within the AEC of this project site. This
innovative stormwater design must be installed and certified by the design engineer before the permit expires and must be maintains
for the life of the structure addressed.
In order to prevent sedimentation, a vegetated buffer zone must be maintained between all disturbed areas and the adjacent water
body or marsh. Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales or burlap must be install
between the land -disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized
with a vegetated cover.
Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third

qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit m„st cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on December
31, 2006
In issuing this permit it is agreed that this project is consistent
with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

Dear Mr. & Mrs. Gyure:
We originally accepted your application under the impression it was full and complete. On
subsequent review, we found that the drawing submitted does not meet the Division of Coastal
Management's estuarine shoreline regulations. Accordingly, we request you to provide us with
the following information:
1. Submit an engineered stormwater design for the impervious surface coverage
beyond the thirty percent (30%) allowance.
In accordance with the Department of Environment and Natural Resources regulations, we note
that a certain time has passed while the application has remained in our office. Accordingly,
upon resubmission of a complete application, a local decision will be made in seventeen (17)
days, provided this period is not extended as provided by law.

The N.C. Division of Coastal Management hereby acknowledges receipt of your application for
State approval for minor development of your property located at 540 Kinston Ave., Atlantic
Beach in Carteret County. It was received complete on August 11, 2003 and appears to be
adequate for processing at this time. The deadline for making a permit decision is September 5,
2003.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be notified.
