Cooper authorizing development in Atlantic Beach Estuarine Shoreline at 105 North Shore MHP Carteret County as requested in the permittee's application, dated 8/25/03 This permit, issued on 8/29/03 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. 03-25 Permit Number This is a modification to the existing permit authorizing the replacement of a mobile home 23' landward of the bulkhead to include the construction of a sundeck over the mobile home with a walkway and steps, more than 30' landward of the bulkhead, leading up to it located at 105 North Shore MHP. Any other development will require additional permits or a modification of this permit. The following conditions shall apply: All proposed development and associated construction must be done in accordance with the permitted workplat drawing as submitted, stamped and received on July 8, 2003. The walkway & overhead deck construction must be done in accordance with the permitted workplat drawing as submitted, stamped and received on August 25, 2003. The size of the new mobile home is 13'-10" x 66'-2" (719.16 sq. ft. within the 75' AEC) whereas the old mobile home was 12' x 61' (660 sq. ft. within the 75' AEC) with a 4' x 15' storage shed (60 sq. ft. within the 75' AEC). The old mobile home was 20' landward of the bulkhead, but because of the increase in impervious surface coverage of the new mobile home, the new mobile home must be placed 23' landward of the bulkhead. Please note that both the old mobile home and the storage shed had already been removed and measurements were taken by the visible footprint in the grass. The walkway & overhead deck must remain open for as long as this lot is developed. All construction must conform to the N.C. Building Code requirements and all other Local, State and Federal regulations. Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. In order to prevent sedimentation, a vegetated buffer zone must be maintained between all disturbed areas and the adjacent water body or marsh. Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales or burlap must be install between the land -disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetated cover. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third party. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit m„st cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. . All work must cease when this permit expires on December 31, 2006 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. Shore MHP Minor Permit Request Atlantic Beach Dear Donna and Kelli, Thank you for your coordinating approach to the proposal offered by Mr. Buddy Cooper for 105 N. Shore MHP. As we discussed on -site, a critical component of this application is the size of the previously existing mobile home unit and any additional impervious surfaces within the Coastal Shoreline Area of Environmental Concern. Since Mr. Cooper did not retain any records or evidence of the pre-existing unit, on June 16, 2003 we measured the size of the shaded or impacted area to determine the amount of impervious surface pre-existing at 105 N. Shore MHP. During this visit, we agreed that the pre-existing unit appeared to be 12' by 61' with a 4' by 15' storage building located off the east side. This pre-existing unit appeared to have covered 792 ft2 of impervious space on this lot. The new proposal requests a new unit 13' 8" by 66' which equates to 901 ft2 at the same location 20' landward of the bulkhead. This brings us to how to process this new request. One option would be to replace the existing mobile home with a unit of the same size or smaller. Based on a July 9, 1993 policy statement this could be accomplished without the need of a CAMA permit but appears not to meet the applicant's goal. Any proposal requesting a larger unit would require a CAMA minor permit. A larger unit may be positioned on the lot and not require full disclosure of the park if the amount of impervious surface is not increased beyond the existing amount. In this example, the proposed unit would need to be moved approximately 2.5 feet landward of the pre-existing unit to not have an overall increase in the amount of impervious surface within the 75' Coastal Shoreline AEC. If the proposal were to change and move back 2.5', a minor permit could be issued for the new unit. A subcategory of this second option may also be used if the applicant can remove the balance between the pre-existing unit and the proposed unit somewhere else within the tract of land. In other words, if the applicant removed a 20 ft2 storage building on lot space 120 within the 75' AEC he could use that amount to balance the increase on lot 105. The last option would be for the applicant to disclose the entire park and demonstrate how this increase in imperviousness would not exceed the 30% limitation for the entire tract of land. Once again this is reflected in a policy statement made by our Assistant Director, Charles Jones, July 9, 1993. It states, "A larger size mobile Atlantic Beach Inspections 105 N. Shore MHP Atlantic Beach June 24, 2003 home will require a CAMA permit and must meet the use standards for the Coastal Shoreline (particularly the impervious coverage requirement). Because a mobile home park is in single ownership, the whole shoreline of the park area will be used when calculating the lot area." I hope this correspondence helps in determining the correct procedure for the issuance or denial of the subject minor permit. If the applicant were willing to change his proposal with an additional 2.5' between the bulkhead and the proposed unit it would make the current proposal permittable. If the applicant chooses to leave the proposal as is it will require a full disclosure of the park showing the existing amount of impervious surface within the 75' Area of Environmental Concern. What you have showing as previously existing on the lot is inconsistent with the on -site visit that was made June 16, 2003. 1 met with Brad Shaver from the Division of Coastal Management and we measured the area of the lot with the visible change in color of the grass. Our measurements showed that a mobile home 12' x 61' and a storage building 4' x 15' had existed on the lot. These measurements give a total of 792 square feet which is less than what is being proposed for the lot. A mobile home 13'8" x 66' will exceed the previous impervious coverage within the 75' Area of Environmental Concern. We received a letter from Brad Shaver today that lists the options that you have. I have enclosed a copy of this letter. As it states in Mr. Shaver's letter, if you would be willing to place the new mobile home 2.5' plus the proposed 20' from the bulkhead, then a CAMA Minor Development permit can be issued because the square footage within the 75' Area of Environmental Concern would be less than what existed there before.
