Dear Ms. Davis,
This letter is in response to your request for a delineation of the coastal wetlands on your
property located at Lots 12 and 13, Dorothy Pake Heirs Subdivision in Smyrna. As you know, I
visited the property with you in November to look at the survey that Powell Surveying had done
representing the wetlands onsite. There was some question at that time as to whether the US
Army Corps of Engineers had accepted either of the two alignments that were shown on the
survey. Additionally, there was some difficulty in ascertaining whether the coastal wetland
species on the property actually function as coastal marsh in their interaction with the estuarine
system. At that time, I told you that I would feel more comfortable if my District Manager, Mr.
Ted Tyndall, visited the property.
On November 15, 2001, Ted and I made a site visit, and both scratched our heads over the site -
specific indicators. Unable to make a definite determination, we set another appointment to visit
the site during a high tide, on December 04, 2001. At that time we determined that a significant
amount of the coastal wetland species are not interacting with the estuarine system on a schedule
meeting our requirements. Consequently, we did not take coastal marsh jurisdiction over this
area of the property. We did not flag the line, as there is no proposal at this time for
development of the property, and the delineation is only valid for 90 days. The line is currently
5' to 15' east of the flagged 404 Wetland Line on the west side of the property. There is no
coastal marsh on the east side of the property. As a general rule, if all development is to be east
of the old roadbed, it will not be located in coastal marsh.
Please note that the coastal system is dynamic, and can change rapidly. The property in question
appears to be in transition, hence the difficulty in determining jurisdiction. It appears that there
has been a loss of woody vegetation on the property in recent hurricanes. This can dramatically
affect the ecological community onsite. When you have a potential buyer with a specific
proposal for development, I will be glad to flag the wetlands at that time for their proposal. If

This permit, issued on December 9. 2002 is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittae to a fine, imprisonment or civil action, or may cause the permit to be null and void.
To install fill pad, septic tank, drain lines and add sand and rock for driveway
area 190' long and 11' wide to be located 43' from the NHW of Jarrett Bay in the
ORW (area of environmental concern).
The amount of impervious surface area shall not exceed 25% of the lot area within
the 575' area of Environmental concern (ORW).
A 30' buffer zone must be provided from the mean high water line (Normal Water LIne).
All proposed development and associated construction must be done in accordance
with the permitted workplat drawing as originally submitted on November 27, 2002.
All construction must conform to the North Carolina Building Code Requirements
and all other local, state and federal regulations.
Any change or changes in the plans for development, construction or land use
activities will require a re—evaluation and modificiation of this permit.
Pursuant to 15 N.C.A.C., Subchapter 7J.0406(B), this permit may not be assigned,
transferred, sold or otherwise disposed of to a third party.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mh rn ,st cease until the appeal is resolved.
This permit must be on the project silo and accessible to the
permit officor when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this parmit requires further written permit approval.
All work must coase when this permit expires on December
