Along with requiring special care by those�who build and develop,,the General Assembly directed the Coastal ` g Resources Commission (CRC) to implement clear regula- " tions which minimize the burden on the applicant This application for a minor development permit under' - CAMA is part of the Commission's effort to meet the spirit and intent of the General Assembly. It has been of designed to be and require no more 3 time or effort necessary from the applicant. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This Permit authorizes the improvement/paving of 9`h Street, for a distance of approximately 150' not of Emerald Drive, to a width of 25', contingent upon the following conditions: 1. All work must be accomplished within the existing public right of way. 2. No work is authorized within 100' of the normal high water contour of Bogue Sound. 3. All proposed development and associated construction must be done in accordance with the permittt workplat drawing(s) as originally submitted, or as revised on 1/27/00. 4. Any change or changes in the plans for development, construction, or land use activities will requi: a re-evaluation and modification of this permit. 5. Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales, or b must be installed between the land -disturbing activity and the adjacent marsh or water areas, until time as the area has been properly stabilized with a vegetated cover. SEE PAGE #2 FOR ADDITIONAL CONDITIONS: This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit m„st cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All work must cease when this permit expires on December 31, 2003 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed or to a third -party. 7. The amount of built -upon area shall be limited to no more than 25 % of the AEC area of the land to be developed; in this case, the entire roadway system is considered "the project"; and cannot exceed 25 % coverage of the land area within 575' of MHW, in its entirety. 8. No wetlands are authorized for filling or excavating with this permit.
