Along with requiring special care by thosewho build and .develop, the General -Assembly directed the Coastal r Resources Commission (CRC) to implement clear regula y tions which minimize the burden on the applicant. This application for a minor development permit under, CAMA is part of the Cor=' ission's effort to meet the spirit and intent of the General Assembly. It has been designed to be straightforward and require no more time or effort necessary from the applicant. Please go over this folder with the Local Permit Officer (LPO) for the locality in which you plan to build to be certain that you understand what information he or"she needs: Under CAMA regulations, the minor permit is to be issued within 25 days once a complete application is in hand. Often less time is needed if the project is simple. The process generally takes about 18 days. You can:` speed the approval process by making certain that your, application is complete and signed, that your drawing, meets the specifications given inside and that your,,, application fee is attached.1 Other permits are sometimes required for development _ = in the coastal area. While these are not CAMA-related; . we urge you to; check with the Local Permit_Officer to determine, -which of these you may need. All proposed development and associated construction must be done in accordance with the permitted workplat drawing dated revised 10/12/00 and the cross section drawing dated received 9/14/00 unless amended by the following conditions. 2. This permit authorizes the Town of Emerald Isle to construct a "Hatteras ramp" to be used by town emergency vehicles, public works trucks, and for storm cleanup. 3. In order to avoid weakening the protective nature of the remnant dune system, the "Hatteras ramp" shall be positioned on the access site to minimize any damage to the existing vegetation. 4. Since settling of the pushed up sand located at the dry sand beach/dune interface has occurred since the original survey work was done, no excavation of the pushed up sand shall occur. 5. The "Hatteras ramp" shall be no greater than 10 feet in width and shall be constructed of wooden sections fastened together over the length of the affected dune area. 6. The permittee is required to contact DCM at 252-808-2808 to arrange a setback measurement (for the rock access) that will be effective for sixty (60) days barring a major shoreline change. Construction must begin within 60 days of this determination or the measurement is void and must be redone. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit m.st cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All work must cease when this permit expires on December 31, "-7003 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. This permit may not be transferred to another party without the written approval of the Division of Coastal Management. The project site is located between blocks 43 and 44 at the existing oceanfront public access, between Sea Dunes and Dear Horn Dunes, in the Town of Emerald Isle, Carteret County. The proposed project involves the construction of a 10% wide wooden Hatteras ramp to be used by Town and emergency vehicles. It also includes the installation of a rock gravel access located outside the oceanfront setback and a gate limiting unauthorized vehicle access onto the beach. The North Carolina Division of Coastal Management has given your objections careful consideration and has determined that the project is consistent with the appropriate regulations of the Division. Consequently; the Division issued CAMA Minor Permit #70-00 to the Town of Emerald Isle on November 21, 2000. Conditions on the permit included no excavation of the "pushed up" sand, the necessity to avoid damaging existing vegetation, and limiting use to Town and emergency/public works/cleanup traffic. If you wish to appeal this permit decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within 20 days of the permit decision. On subsequent review, we discovered that it lacked certain necessary information to adequately evaluate the proposed project. Subsequently, the application was placed on hold pending submission of the necessary information/documents. This office then received plat work from Mr. John Odum with Prestige Land Surveying, Unfortunately, there were some items shown on the survey that were not discussed during our site visit nor discussed on the application, including a 40' long retaining wall. Therefore, I suggest that we meet at the site once agai n with the surveyed plats and discuss the project before the project is taken off hold and final action is taken. Unfortunately, I will be out of the State until Friday morning. If you have the time, I can meet with you early Friday afternoon, October 6, 2000. If you get the chance, please call my office and leave a message with Ronda as to whether you can meet that day. On subsequent review, we have discovered that it lacks certain necessary information to adequately evaluate the proposed project. And on July 12, 2000 Mr. Jim Taylor and I discussed the additional information needed. Consequently, the application has been placed on hold pending submission of the necessary documents/information. However, after my discussion with Mr. Taylor I continued to review the proposed project and the information in the file. I do want to inform you that I have received several letters from individuals objecting to the proposal. The reasons for adjudging the application to be incomplete include the need for a survey with topographic information, a cross section of the Hatteras ramp with elevations of the project site and a plan view of the proposed work with appropriate dimensions. In accordance with the Department of Environment and Natural Resources regulations, we note that a certain time has passed while the application has remained in our office. Accordingly, upon submission of a complete application, a local decision will be made within a day, provided this period is not extended as provided by law. Sincerely, M. There is a public walkway currently located between my duplex and a duplex called "The Surfer". I have just received a letter from the town of Emerald Isle indicating that they want to place a vehicle access ramp where the public walkway is currently located. I am strongly opposed to this change for the following reasons: The public walkway is located at a spot that has very little dune protection and is low in elevation .When people walk to the beach they keep the dune cut down and make a path for the ocean when a major storm "hits". The last two major hurricanes that have visited Emerald Isle have left enough lumber and debris in my backyard and on the public walkway to build a house. I have spent a lot of money and effort trying to build up the dunes in this area. The town of Emerald Isle has cooperated with me and raised a wooden walkway over the current dune to try and solve this problem. The walkway is still too low, but an improvement over the past. A vehicle access ramp would provide a perfect place for any hurricane or unusual high tides to gush through to the street. It very well may lead to extreme erosion and the undermining of my duplex. I had to have professional house movers level my house after hurricane Fran. It is my understanding that this ramp would be only for special vehicles and that a cable would be placed across the path to prevent other vehicles from passing. Both my duplex and the "Surfer" have a large number of rentals each year. This certainly would discourage any guests from choosing our houses because of the ramp being unsightly and the sand ruts that would result from commercial trucks used to patrol the beach and pickup garbage. Guests will not appreciate being awakened by the trucks passing within a few feet of each property. Can you imagine paying $4000 a week for ocean front property and having a previously beautiful view marred by a commercial ramp. In addition I feel this will greatly reduce property value in the area, especially "The Surfer" and my property. Many people using the current public walkway refuse to walk on the sand path and use "The Surfer's and my driveway. If a cable is placed across the path, we can expect more people to trespass and create new unwanted paths to the beach. . It is my understanding that the town currently has beach access across from the town hall. They will not be able to reach any point west of Pebble Beach any quicker from 9315 Ocean Drive than from a straight drive up the beach. They may even be able to reach it sooner as they will not have to deal with traffic lights, stop signs and turns. If the tide is too high for them to drive on the beach, it would be too high for them to be down there anyway!
