In.'response to your inquiry regarding improvements between the
30X and the 60X setback, it is my understanding that only the non -
movable structure as defined in T15 NCAC 7H.0306(a)(4) must be aligned
landward of the 60X setback. Related facilities (i.e.,-parking lots,
swimming pools, or even movable structures) can be situated between
the 60X setback and the 30X setback providing that the development
in this area does not contravene any of the local or State guidelines
or regulations. In these situations, special attention should be
focused on compliance with the regulations regarding the alteration
or removal of dunes.
I'hope that this information will help clarify our regulations
regarding such matters.
