PERMIT
In 1974, the North Carolina General Assembly passed
the Coastal Area Management Act and set the stage for
guiding development in the fragile and productive areas
which border the state's sounds and oceanfront. Along
with requiring special care by those who build and
develop, the General Assembly directed the Coastal
Resources Commission (CRC) to implement clear regula-
tions which minimize the burden on the applicant.
This application for a minor development permit under
CAMA is part of the Commission's effort to meet the
spirit and intent of the General Assembly. It has been
designed to be straightforward and require no more
time or effort necessary from the applicant. Please go
over this folder with the Local Permit Officer (LPO) for
the locality in which you plan to build to be certain that
you understand, what information he or she needs.
Under CAMA regulations, the minor permit is to be
issued within 25 days once a complete application is in
hand. Often less time is needed if the project is simple.
The process generally takes about 18 days. You can
speed the approval process by making certain that your
application is complete and signed, that your drawing
meets the specifications given inside and that your
application fee is attached.
Other permits are sometimes required for development
in the coastal area. While these are not CAMA-related,
we urge you to check with the Local Permit Officer to
determine which of these you may need. A listing is
included on page 2 of this folder.

Commission prior to onset of construction.
2. There is to be no roof constructed over, nor any gravel, asphalt, concrete, or other improvements
under the deck shown as "uncovered" on plats submitted August 1, 1997.
3. All improved, hardened, or covered surfaces, to include but not limited to, covered structure, parking
and drive areas, must not exceed 32% within 75' of the mean high water contour (in this case the
bulkhead) of the White Oak River. In the case 5096 sq. ft. is proposed and accepted.
1. All proposed development and associated construction must be done in accordance with the
permitted workplat drawing(s) as originally submitted on 8/1/97.
2. Any change or changes in the plans for development, construction, or land use activities will require
a re-evaluation and modification of this permit.
3. Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales, or burlap
must be installed between the land -disturbing activity and the adjacent marsh or water areas, until
such time as the area has been properly stabilized with a vegetated cover.
4. The bulkhead alignment will approximate the MEAN HIGH water level at the time of construction.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit must cease until the appeal is resolved.

Dr. Schindelar Is requesting the opportunity to rebuild a building to replace the old
Christmas Shop and a small residence that were washed away during the hurricanes of
1996 on his property located at the waterfront Interior comer lot at Front and Church
Streets in Swansboro, at the end of the Through the Looking Glass Building and next to
the new Bynum shoptresidence recently built on the river.
Background Information:
The lot measures approximately .37 of an acre (see attached plot plan).
Property Is located In Federal' V' Flood Zone.
The proposed new construction will be in the CAMA Zone, which is where the
old buildings sat.
The proposed new building will set back from Church.Street approximately 100
feet and from water 5treet approximately 250 feet.
The required new building set backs are approximately 25' to the front, 10' to
the rear, and 10' at corners.
The new building will be elevated on 8x8 pilings that will not be exposed because
of the break -away walls below.
There is an approximateiy 3V utility and drainage easement and 10' strip of
property belonging to Jessie Moore adjacent to the southwest corner of the
property, behind the existing building, as well as a 6' access drive to the property
from Water Street.
• Parking and landscaping wail be submitted for review at a later date. The
property already has a large parking area and an abundance of land to
accommodate any required parking spots.
• The new building foot print percentage to building lot is 21%. The previous
bulldings footprint percentage to building lot size was 19%.
The overall footprint of the new building is 80 feet wide by 52 feet deep, including
porches and decks.
The new structure will not exceed the 35' maximum to the ridge of the roof.
The main level will have approximately 3,371square feet, including parches,
There is an additional 500 square feet of uncovered deck on the water.
The ground floorvrill be used as storage for the building.
The first habitable floor level above ground level may contain a restaurant. It will
have two toilet rooms, 2 dining areas, a kitchen area with storage, a covered
entry porch with stairs and a chair lift under the porch roof on the north side, a
covered porch to the south west (right) side of the building, and a deck with trelfis
on the water side.

The building will comply with NC Handicap codes throughout, including the
bathrooms, entry and exit. A commercial Chair lift will be discreetly placed at the
entry porch and screened with lattice, as allowed by the manufacturer.
The new building ground floor break -away walls will be covered with 12" boards
with 2" vertical battens, as seen on many old houses in the area. This will
material will serve to visually "ground" the house. There will be a V" skirt board
at the first floor level to break up the materials on the ground and first floors.
The siding on the building will be cedar shakes with an 8" exposura, painted In a
historical color to be determined. Corner boards, fascias, columns and rails will
be painted white. The new building roof is a gable design covered in either tin,
architectural or concrete shingles. Roof color will be a charcoal grey. The new
building will have louvered full height window shutters at the six over six windows,
which are 3 feet wide by 6 feet long. The shutters will be painted In a
historical color to be determined. Windows and window mullions will be painted
white. All porches floors will be 514 board treated decking with rounded edges.
They will be stained grey. Doors will be 6' wlde15 lite French doors with elliptical
transoms on the water side, painted white.
All porch and deck rails will meet the NC Building Code. Pickets will be 2x2
materials and the cap will have a rounded edge detail. AD rails and posts will be
painted whine.
The new building will be elevated approximately 10 feet above the grade to
lowest structural floor member.

meeting at which the application may be considered.
It is the policy of the Historic District Commission that the Commission shall act as one body. Accordingly, individual members
should not give personal opinions on applications submitted to the Historic District Commission, and no such individual opinion
shall bind the Commission in any way.

The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) that application for a development permit in an Area
of Environmental Concern as designated under the CAMA was received on July 8, 1997.
According to said application, Port O'Swannsborough, are proposing to construct a
Commercial Building at a site located adjacent to Front and Church Streets, in the Town of
Swansboro.
A copy of the entire application may be examined or copied at the office of Tere
Barrett, Division of Coastal Management, located at Hestron Plaza II, 151-B Hwy. 24,
Morehead City, NC, 808-2808 during normal business hours.
Comments mailed to Roger N. Schecter, Director, Division of Coastal Management, P.

FOR DEVELOPERS IN OCEAN HAZARD AND ESTUARINE HAZARD AREAS:
I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the
particular hazard problems associated with this lot. This explanation was accompanied by recommendations
concerning stabilization and floodproofing techniques.
PERMISSION TO ENTER ON LAND
I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer
and his agents to enter on the aforementioned lands in connection with evaluating information related to this
permit application.
This application includes: general information (this form), a site drawing as described on the back of this ap-
plication, the ownership statement, the AEC hazard notice where necessary, a check for $50.00 made payable to
the locality, and any information as may be provided orally by the applicant. The details of the application as
described by these sources are incorporated without reference in any permit which may be issued. Deviation
from these details will constitute a violation of any permit. Any person developing in an AEC without a per-
mit is subject to civil, criminal and administrative action.

Please make sure your site drawing includes the following information required for a CAMA minor develop-
ment permit. The drawing may be simple and not necessarily to scale. The Local Permit Officer will help you,
if requested.
PHYSICAL DIMENSIONS

label local setback lines
label any and all structures and driveways currently existing on property
PHYSICAL CHARACTERISTICS
draw and label mean high water mark (MHW)
draw location of septic tank or filter field
If you will be working in the ocean hazard area:

identify and locate first line of stable vegetation
