imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes Terrace 21 foot bluff, bottom wall 100' long, 7' high: middle wall approx. 70' long, T Flip; top wall 50' long, T
high. All walls wilt be similar to sea walls. Terrace will be approx,18' wide.
All proposed development and associated construction must be We in accoruance witn rule petmlueo warK plat
drawings($) dated received on April 20, 2006.
All construction must conform to the N.C. Building Code requirements and all Other local, State and Federal regulations,
applicable local ordinances and FSMA Flood Regulations.
Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
A copy of this permit shar be posted or available on site. Contact this office at 252-745.3861 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal. any
work conducted under this permit must cease until the appeal Is resolved. This
permit must be on the project site and accessible to the permit officer when the
project ' is inspected ror compliance. Any maintenance work or project
modifeation riot Covered under this penrut, require further written permit
approval. All work must cease when this permit expires on:

(5) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of Normal Water Level
(Estuarine Shoreline Area of Environmental Concern), in this case, 3,960 square feet is authorized.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a banter line of filter cloth must be
installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has
been properly stabilized with a vegetative cover.
(7) All otherdisturbed areas shal be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.
NOTE: All development must comply with the Neuse river Buffer Rules as stated in 15A NCAC 1 B .0269. Any questions

Coastal Management, Morehead City Office that the Coastal Area Management Act
Minor. permit application for your proposed project at 167 Indian Bluff Drive, Arapahoe,

application including rip rap along the base of the lowest retaining wall. Based on this
request, processing of your application will be placed on hold until such time as a written

At the request of your client, I have visited and inspected the site of bulkhead
construction proposed by ?&. Humenik looted along the Neuse River shore in the Ind :,a
Bluff Subdivision in Pamlico County, North CaX011t L The proposed construction site i.,
located between the adjoining property of Benedict on the down river side and the
adjoining property of Spiegel oa the upriver side. In addition to the site visit, I have
reviewed documents furnished by your office as copies of the CAMA application
submitted by Mr. Humenik for approval of consnvction of the terraced bulkhead slonr
his Neuse River shore.
My comments relative to the proposed terrace bulkhead construction is as follows:
1. The bulldread creates a "hardened" shoreline that during periods of high storm
tides and wind driven waves will increase the velocity of the storm water alon,c
the buH!4ad and thus increase the possibility of erosion of the adjacent proper
that is not hardened in a similar rnannef.
2. The terrace construction proposed will increase the protection of the Hmnenik
property from storm driven wave erosion. However a similar level of protectit u
could probably be obtained by placing additional 4rani[e rip -rap stone protectit -i i
along the toe of the slope and moving the proposed Humenik residence strucr
farther away from The crest of the bluff to be more in line with the adjoining
existing- smuctures on either side_ This additional rip -rap stone at the base of It
slope would provide a second line of protection behind the existing stone alotti
the actual normal water edge and should be continued onto the adjoining

3. The proposed construction of the terrace and the grcenhousa appears to be loca:: d
within the Neuse River Buffer area and this may require added permits and
possibly will not be allowed.
4. It is recommended that only granite rip -rap stone similar to that now existing at
the top course of the rip -rap along the Humeuilc shore protection be used if a&
anywhere along the subject site at least up to elevation +12 feet. The shell rock
limestone rip -rap is porous and develops buoyancy that allows the water waves t u
move the scone and lose the protection that the stone should provide.

like to register an objection to the CAMA Minor Development Permit Application, submitted by
Mr. Dennis Hamenik un April 12, 2006 for construction and installation of terraced bulkheads, a
greenhouse, and sol;,r collectors on the bluff facing the Neuse River_ Our clients own the lots on
either side of Mr. HumeaWs property.
We previously discussed our clients' cortcams with Stephen Lane, Field Officer with the
Division of Coastal Mmageuuat, As we Stated to W. Lane., our clients object to any suucwre
that will cause or contribute to erosion along their respective shorrlincs. They are, coacemed that
if Mr. Hubluff is terraced and a bulkhcdd is installed, the configuration of hie shoreline
and bluff will be incompatible with theirs and the chances for accelerated erosion of their bluffs
during future storms will increase.
Further, we believe Mr, Humenik`s construction will require a"tiotral permits' that trigger the
need for a CAMA Major Development Permit_ First, his development activities are in an area of
tnvironmental concern within one-half mile of surface. area waters and therefore may require a
State StormwatcrMaugement Permit uader 15A NCAC 2H.1003(d). Second, the development
wilI disturb land within Zone 2 of the riparian buffer of the Neuse River Basin and thus requires
