Coastal Area Management Act, Sec. 07H.0308 (a) (3) 1. "Property owners may, in emergency sutuations, obtain AEC permits to protect existing structures along the oceanfront by means of bulkheads seawalls, or similar structures if it is determined that the structure is threatened." 2. An inspection of the site by the local permit officer on February 21, 1983 showed wave action upon the glass of the dining room of the structure, within 20 feet of the structure itself, the protective dune having been destroyed by winter storm waves. 3. Applicant's project represents a new technology in erosion control activities and has been determined minor development by OCM field consultants. (see attached memo) Based on the "similar structures" language of Seca 0308 (a)(3) and the precedent established by the Cape Hatteras Lighthouse Seascape Project, the LPO has made the determination that "seascape" is a permitted activity. _ This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing G'/ • �d .c a e•T date. This is the follow-up memo I promised during our February 2, 1983, short working session. .We discussed the following: a.' Tan-R-Rama Hotel erosion:- The recent northeaster has undermined the existing bulkhead at this site and subsequent erosibn has robbed the backfill of this structure, destroying the hotel septic system. The owner of this structure should repair this bulkhead immediately so we can apply the statutory exemption from CAMA permit requirements outlined in GS 113A-103 (5)(b)(5). The owner should be warned, repair of this structure is exempt, however replacement will be subject to CAMA permit requirements. He should act as .soon as possible while there is a structure to repair. ' b. The Bel -Air motel: The owner of this structure will need CAIIA minor permit authorization prior to clearing the concrete walkway on the ocean side of this structure. The clearing of sand should be limited to the concrete only, with the sand from this operation being placed immediately waterward of this pad but no further than the adjacent line of vegetation. c. The Cal-de-Sol=.condominiums: Recent overwash has placed sand against this struc- ture and the owners may wish to use motorized equipment for its removal. This clearing should be limited to within 8' of the existing doorways,'with the sand being used to reestablish the dune. This work will require permit authorization, as will the proposed retaining wall you mentioned. d. Sea Ranch, and others, Seascape proposal: This work will require CAHA minor permit authorization. The drawings and.information that will be provided in the application for the Corps'of Engineers Permit, will be satisfactory for your review of the project. He will have to provide additional material, such as deeds and the required check for advertisement along with these materials, in order to consider the application.complete. e. Kill Devil Hills Beach access areas: Clearing not of these areas technically needs CAMA permit authorization. The only real way it can be justified is if .the areas were previously paved and the work is necessary to keep them clear. All sand should be returned to the dunes in the immediate areas. A'single permit covering all these areas should be secured, maybe with a maintenance clause to allow periodic work after contacting you. Box 719- /= Kill Devil Hills, NO 27948 Dear Ms. Gray: This is in response to the public notice and call for comments regarding the application for a minor permit by SbA Ranch II; Kill Devil Hills, NC to install 1600 units of Seascape, an erosion control device, in the Atlantic Ocean at Kill Devil Hills. Section T15:07H.0308(a)(7) of the North Carolina Administrative Code revised 04/05/82 specifies that "Shoreline erosion control structures (excluding beach nourishment and berm projects) shall only be allowed when their purpose is to protect development that was existing as of June 1, 1979. I believe that the Sea Ranch II, the Casa Del Sol, and perhaps other structures associated with the property owner listing in the application are therefore ineligible -for a permit for shoreline erosion control structures. "Property owners may, in emergency situations, obtain AEC permits to protect existing structures along.the ocean front by means of bulkheads, seawalls, or similar structures if it is determined that the structure is threatened...[andl is one that was built prior to June 1, 1979, and where the apparent erosion rate is such that the structure's foundation is -imminently endangered..." according to T15:07H.0308(3). Certainly this is -a -reasonable regulation. . However, many of the structures asso- ciated with the property owner listing in the application are not imminently endangered, and are therefore ineligible to obtain an ABC permit. - For those remaining structures eligible for an ABC permit, sections T15:07H.0306(i)(1) and .0308(a)(4), respectively, require that "Devel- opment shall incorporate all reasonable means and methods.to avoid or minimize adverse impacts of the project.. These measures shall be im- plemented at the applicants expense and may include actions that will... minimize or avoid adverse impacts'by limiting the magnitude or degree of the action." and "All structural erosion control projects shall demonstrate sound engineering for ocean shoreline erosion control projects." It is understood that the purpose of the Seascape installation is to form an offshore reef to cause large waves to crest and break before -2- W.C. Billy Gray 9 lurch, 1983 reaching the shoreline, and thus to minimize beach erosion caused by the action of large individual waves. The Seascape planting, however, should not interfere with littoral drift and sand transport during periods of large or small'wave action, especially because the planting is far enough off shore that disturbance of littoral drift and sand transport would have far reaching downstream effects with possible resultant severe erosion. Section'T15:07H.0800(b) states "In gross overall aspect the barrier islands have not been reduced in area to any great extent since an ample supply of sand is available to maintain the barrier island system. Particular stretches along the coast, however, may show accretion or erosion dominant. Even slight natural or man-made irregularities ..in the shape of the shore can obstruct the longshore sediment flow. In addition, other wind driven currents can develop along an open coast. Where various currents converge or diverge, significant deposition or erosion can occur along adjacent stretches of beach...." In :peeping with the relevant considerations cited, I believe that the applicant should demonstrate that the project is engineered to create a reef that will simulate the -desired natural ocean bottom contours which will in turn have the desired erosion reducing effect, but will not create undesirable adverse impacts including interference with littoral drift. Moore: This will confirm various aspects of our telephone conversation of last week regarding the CAMA monor development permit for the in- stallation of Seascape at the Sea Ranch Motel in Kill Devil Hills. I expressed my concern over the local newspaper reports that Seascape units were being installed about 100 to 150 feet offshore. While it is clearly recognized that newspaper reports are not technical evaluations, the apparent question is the location of the MHN as identified in the permit and the control used to establish the location of the Seascape installation relative to the IIEW. I also expressed my concern over enforcement of minor permits issued by the Office of Coastal lanagement rather than a Local Permit Officer. The past practice of LPO enforcement of minor permits is not applicable when the LPO does not have jurisdiction. You agreed to look into these matters in cooperation with Nelson Paul. The rules of the Coastal Resources Commission require that you receive an AEC hazard notice and acknowledge that notice in writing before any permit for development in this area can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alteration are designed to minimize, but not totally eliminate, property losses from the hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the, development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that Date - the annual ocean erosion rate for the area where your property is located is feet per year. This figure was established by careful analysis of aerial photographs of the coastline taken over the past 30 to 40 years.
