DENIAL
The Local Permit Officer, having examined the site and reviewed information
presented in this application, makes the following observations: 1) Since the
statutory review period of 30 days has expired this permit is issued as a
passive grant. All materials submitted in the initial application made on
February 3, 1982 are incorporated into this permit (see at application).
2).Note that on the site drawing .there is only sufficient room for a building
25' deep between the septic tank filter field and the CAMA setback. **(BELOW)
BASED ON THESE OBSERVATIONS, the officer concludes that this permit application
should be granted (If this is not a denial or conditional permit, strike
out the rest of this section.)
This permit should be denied in that it violates
(1) NCGS '113A-120(6); the development unreasonably endangers life or
property, namely, _—
(2) NCGS 113A-120(8); the development is inconsistent with the state guide-
lines, particularly 15 NCAC 7H which requires that
this project calls for
(3) NCGS 113A-120(8); the development is inconsistent with.the local land use
plans, see p. of plan which provides that
this project calls for
HOWEVER, a CONDITIONAL PERMIT is issued the applicant if he indicates his
willingness to accept the.following conditions; (these conditions must be
accepted by the applicant within 10 days of the below date or this permit is
deemed denied. Acceptance is made by signing and returning this form to your
local permit officer.)

Dear Mr. Ward:
Enclosed is a passive.grant permit for Mr. Al Eike, CAMA #82-001. This permit is
issued without any conditions but does incorporate all information submitted with
Mr. Eike's February 3, 1982 application.
As you will recall, Charles Pattison from our Raleigh office and I met with you to
review the project dimensions on the site. Based on that meeting, we made measure-
ments which were almost exactly the same as the ones shown on the site drawing. The
result was that a space 25' deep remains for the placement of a structure between
the 60 foot CAMA oceanfront setback (measured from the first line of stable natural
vegetation) and the septic tank filter field.
Even though a passive grant has been given in this case, the following conditions
apply to all permits involving construction seaward of the normal oceanfront setback
(120' from the vegetation line at this site) as allowed by 15 NCAC 7H.0309(b):
(1) all pilings must extend four feet below mean sea level and (2) the lowest habitable
floor of the structure be no more than 1,000 square feet or 10% of the lot size,
whichever is greater (10% of the Eike lot is 1,840 square feet).
All oceanfront permits expire six months after they are issued but may be renewed up
to five times at six month intervals. A permit renewal will be reviewed by me on
August 8, 1982 unless you have already completed your project or conditions have
changed that would cause the permit to be reconsidered.

AEC's, there shall be a written acknowledgement from the applicant that the
applicant is aware of the risks associated with development in this hazardous
area. By granting permits the Coastal Resources Commission does not -guarantee
