Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Attached is a CAMA form providing you the required notice and opportunity for comment regarding the
construction of the above mentioned deck on our existing boat lift. Mary Jo and I sold our 24' boat. We
plan on purchasing a jet ski. The purpose of the deck is to provide access to the Jet Ski when on the lift.
The proposed deck, see attached drawing, will provide safe access on three sides to the Jet Ski. Without
the deck, access to the Jet Ski could present some personal hazard and safety issues.
I would suggest that there are no adjacent riparian issues as the proposed deck is 10' x 10' and will be
smaller than the foot print of the existing CAMA permitted and approved boat lift, 13' x 13'. Given that
foot print relationship I would also suggest that there are no riparian encroachments either toward the
Mitchell Creek centerline, or, the riparian lines of either of the adjacent properties. In addition to
Riparian relationships I am also required to provide notice to adjacent property owners as the proposed
deck is considered additional platform square footage.
Regarding additional platform area, I am permitted by CAMA regulations to have 4 sq. ft. of platform per
each linear foot of shoreline. Lot A's 46' feet of linear shoreline then permits me to have a total
platform footprint of 184 sq. feet. The existing CAMA permitted platform is 5' x 14' or 70 sq. ft.
Therefore an additional platform footprint of 114 sq. ft. is permissible. I am proposing the boat lift deck
be 10' x 10' or 100 sq. ft.
Please review the enclosed drawing and CAMA form and follow the CAMA instructions provided on the
form.

I objected to this proposal based upon incorrect data in the drawing and dimensions provided
with this application.
For instance the drawing of the existing pier shows the platform to be leaning towards Lot `B"
when in fact the opposite is true. I hereby attach my corrected copy of the layout.
Also the boatlift bunks measure 12ft in length starting from between and equal to the existing
pilings on the van der Biezen side. Extending this further with an additional platform would push
this even further into the already violated riparian space. (See attached certified map of Coastline
Surveying, PA).

If the statement in the attached letter from Eichinger that 4sq.ft per linear shoreline (46ft) is
correct than the existing boatlift of 13x12ft = 156sq.ft and the platform of 5x14ft = 70 sq.ft.
already exceeds the legal limit of 184sq.ft. If you add boatlift no. 2 of approx. 156sq.ft. you have
a total of 3 2sq.ft at least double the allowable square footage on a lot of 46feet. Might I ask you
to reduce he existing overage instead of allowing anymore additions.

Re: Deck for existing boat lift
Brad,
Thanks for the call back this morning.
Attached is the original NCDENR permit for the platform and boat lift.
Also attached is the drawing for a deck I would like to construct. The deck
would be fastened on the boat lift. It would have a 4-5 foot wide slot so that
the exposed lift bunks would receive a jet ski. The deck would permit us to
put a jet ski on the lift while having easy walk around access to the jet ski.
The deck materials would be treated lumber, the deck itself! fastened together
with coated screws. The deck would be secured to the lift with stainless
hardware (bolts).
The question is do I need a permit. If no, I would probably ask that we go
through the process and obtain a permit as I expect my neighbor may
petition LAMA for the legality of the deck. I just think a CAMA permit
might be a good way to go.
