Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Brad,
Shop Gut Creek is a highly productive nursery area for shrimp, but since it is maintenance excavation, a small foot print,
and the colder water temperatures, the NCDMF is OK with allowing this work until April 7`h. This gives the applicant an
additional 7 days into the moratorium to complete the work. In the future all maintenance dredging should be performed
outside of the PNA moratorium period.

Can you give me a more exact location of the project (a location map)? How long has he had the permit? What method is
he proposing? Is it possible to use turbidity curtains?

Mr. Hart,
Maintenance excavation around his docking facility. I don't think he does, but I will be glad to get a copy of the permit
to you. Mr. Diamond indicated that he would start work today. He feels that, since he is doing the work himself, he
needs until April 15th to complete the work.

Mr. Hart,
An property owner in Oriental, Mr. Ron Diamond, has been issued General Permit #57200C for the proposed
maintenance excavation around his existing docking facility in Shop Gut Creek, Pamlico County. The permit's expiration
date is reflective of the April Vt dredging moratorium. Mr. Diamond is requesting a two week extension (to April 15th) in
order to complete his project.
(He cites recent personal health issues as the reason for the extension request. This hardship caused an unexpected
delay on the project.)
Will the NCDMF grant Mr. Diamond's request?
