Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Macon Road, Atlantic Beach, NC as requested in the permittee's application dated 7/23/08, including the
attached workT)lan drawings (3)sheet 1 of 3 dated 3/10/08 2 of 3 dated 7/08/08 and 3 of 3 revised 2/13/06.
This permit, issued on December 31, 2008 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Maintenance Excavation
1) In order to protect juvenile fish and shrimp populations, no excavation shall take place between April
1 and July 31 of any year without prior approval from the Division of Coastal Management, in
consultation with the N.C. Division of Marine Fisheries and the U.S. Army Corp of Engineers.
2) No vegetated wetlands shall be excavated and/or filled, even temporarily.
3) No excavation shall take place outside of the area indicated on the attached workplan drawing(s).

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification MSCMvwd
hereunder requires further Division approval.

ADDITIONAL CONDITIONS
4) No excavation shall take place within 10 feet of any area of Coastal Wetland.
5) The temporary placement, or double handling of excavated or fill materials within waters or vegetated
wetlands, is not authorized.
6) Excavation shall not exceed —6.0 feet below the elevation of normal low water within access channel, as
depicted on the workplan drawings. In no case shall the depth of excavation exceed the depth of the
connecting waters.
Spoil Disposal
7) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
8) The disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within 30 working days of project completion.
9) The permittee shall contact a representative from the Division of Coastal Management, Wilmington
Office at [phone] at least two weeks prior to commencement of dredging activities to schedule
an inspection of the disposal area.
10) In order to ensure proper containment of the spoil material, and to prevent unnecessary contamination of
private property and state -maintained roadways during transport of the spoil material, the permittee shall
establish a "wash down" facility for all vehicles used to transport the spoil material to the disposal site.
The transport vehicles shall be "washed down" of all excess material prior to leaving the site.
11) The permittee and/or his contractor shall take all necessary precautions to ensure that the spoil material
is properly contained during transport to the disposal site, and that all the proper coordination has taken
place with the local or state governments to ensure that any damage to public streets caused by transport
of the spoil material has.been addressed.
12) No dredged material shall be placed within 30 feet of the Normal High Water line.
Sedimentation and Erosion Control
13) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlaniki*6courses and property (e.g. silt fence,
diversion swales or berms, etc.).

NOTE: The permittee has received a Sedimentation and Erosion Control Plan for the Town of Atlantic
Beach dredging project (LQS Permit No. Carte-2006-265). Should the permittee choose to
modify/amend the existing permit, he or she should contact the Department of Environment and
Natural Resources; Land Quality Section, at. 127 Cardinal Drive Extension, Wilmington, NC
28405.
General
15) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure, work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
General
16) This permit shall not be not be assigned, transferred, sold, or otherwise disposed of to a third party
without the written approval of the Division of Coastal Management.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit 35
and Nationwide Permit 16(COE Action ORM No. SAW- 2005-00344) on 9/03/08.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3698 and 3700 (DWQ Project No. 08-1278), which was issued on
9/09/08.
