This permit is subject to compliance with this application, site drawing
and attached general and specific conditions. Any violation of these terms
may subject the permittee to a fine, imprisonment or civil action; and
may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-
fies by signing this permit that 1) this project is consistent with the local
land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they
have no objections to the proposed work.
In issuing this permit the State of North Carolina certifies that this project
is consistent with the North Carolina Coastal Management Program.

This correspondence is in reference to your objection to a proposed bulkhead project by
Allen and Kandice Davis, adjacent riparian property owners of yours. The proposed
DONNA D. MOFFITT project site is located at 149 Blue Heron Lane, adjacent to the Straits, in Gloucester,

Carteret County. The proposed project involves the installation of 100' of rock rip rap
along the eroding shoreline.
The North Carolina Division of Coastal Management has given your objections careful
consideration. And during the site visit, Division personnel delineated the landward
extent of the marsh and staked the rock rip rap alignment such that placement of all rock
would be landward of the marsh and above the mean high water line. Therefore, based
on the site visit by Division personnel and a review of the regulations including 15
NCAC .I100 - General Permit for Construction of Bulkheads and the Placement of
Riprap for Shoreline Protection in Estuarine and Public Trust Waters, this office has
determined that the project as proposed and appropriately staked is consistent with the
pertinent regulations of the Division. Consequently, the Division issued CAMA General
Permit #24875-C to Mr. Davis on March 7, 2000.
I have enclosed a copy of the permit for your review. If you wish to appeal this permit
decision, you may file a request with the Director of the Division of Coastal
Management, Department of Environment and Natural Resources within 20 days of the
permit decision. If you have any questions regarding this matter, please don't hesitate to

The enclosed notification/waiver form from Alan and Kandice Davis of 149 Blue
Heron Lane, relative to proposed changes to their shorefront property does not
specify any explanation relating to the fact that this proposal involves property
belonging to the Federal Government, i.e. CAMA, without Army Corps of
Engineers approval of wetland areas.
The proposal does not consider consequences that may have effects on marine
life, shoreline vegetation, redirection of tidal flows, and erosion of abutting
properties.
These factors need further review and explanation as to the propriety of
hardening of an individual section of shoreline which is contrary to the legal
requirements applicable to wetlands.
Without the blessings of the proper authorities -- conveyed to not only abutting
property owners, but anyone along the adjoining shoreline, we respectfully
submit our objection to any approval of this application.

set back a minimum distance of 15' from my area of riparian access unless waived by me. (If you
