may subject the permittee to a fine, imprisonment or civil action; and
may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-
fies by signing this permit that 1) this project is consistent with the local
land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they
have no objections to the proposed work.
In issuing this permit the State of North Carolina certifies that this project
is consistent with the North Carolina Coastal Management Program.

Re: Brandywine Marina - Dredging
Brandywine Marina Association hereby applies for a general permit for maintenance
excavation of its existing entrance channel. We are requesting a permit to dredge a
maximum of 700 cubic yards according to the diagram attached to this letter. The
approvals of the adjacent landowners and the landowner where we propose to place the
spoils will be submitted under separate cover.

RE: Request for maintenance dredging permit at Brandywine Marina, Carteret County

Dear Terry:
I apologize for my poor communication. I now realize I did not make it clear that I was
just waiting for an appointment with you to deliver the adjacent owners documents and
approval for the spoils placement. I just assumed you would make the appointment and
take care of everything at once.
I am now delivering to you the signed statements for the adjacent owners Moore,
Haddock, and Calloway, the approval from Haddock for spoils temporary placement on
her property, and our check for $50.00. I will bring with me the prior permits for your
reference when we meet Thursday May 4, 2000 at 11:00 AM.
I met with Mr. Scott (not sure first or last name) this AM at your office to review the
major permit procedures necessary to complete the break water project under an expired
permit. As I explained, we wish to complete that project which we hope will reduce or
eliminate the future need for maintenance dredging in that area. He explained it would be
a new permit process and gave me the documents to complete. We will be working on
this the next few weeks and submit the whole package when complete. I believe there is
plenty of time as the earliest we would plan is this fall or winter 2000.

As an adjacent property owner to the Brandywine Marina, I have reviewed the map
attached to the Riparian Property Owner Statement and hereby agree that the spoils to be
removed from the areas shown on this map in the amount of approximately 600 cubic
yards will be placed on my property (as also indicated on the map as "spoil area") and will
be allowed to dry, then appropriately hauled off. My property is designated as lots 1 and
2 of the Bay Harbor Village Subdivision, Phase H at Brandywine Bay.
I understand the Brandywine Marina Association will leave the spoils area in a similar
condition as it was prior to this project. It is possible, however, to use what minor portion
of the spoils as is necessary to fill in any existing erosion in the area.
