This permit is subject to compliance with this application, site drawing
and attached general and specific conditions. Any violation of these terms
may subject the permittee to a fine, imprisonment or civil action; and
may cause the permit to become null and void.
This permit must be on -the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-
fies by signing this permit that 1) this project is consistent with the local
land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they
have no objections to the proposed work.
In issuing this permit the State of North Carolina certifies that this project
is consistent with the North Carolina Coastal Management Program.

Residential pier application
1 would like to express my displeasure with your overzealous determination that Dr. Bell
must go through the major permit process to build a residential pier at his property, Lot
22, Spooners Creek North. Dr. Bell lives on lot 23, adjacent to lot 22. He bought lot 22
as an investment. In order to protect and enhance his investment, he would like to build
a pier on the property before regulations become more restrictive. Please consider the
following.
1. Lots 22 and 23 are separately platted.
2. Dr. Bell has a pier in front of his residence on lot 23. He owns two boats, which are
kept at that pier. He does not intend to rent boat -slips.
3. The fact that flowers are planted on lot 22 does not conclude that the two parcels are
being used as one.
4. A pier permit was issued to the former owner of lot 22, but never built. (129-86)
If you really feel that the major permit process in this case will help protect the public
interest (.1204 d), then so be it. There are permitted piers existing along this entire
neighborhood waterfront with lot 22 being the exception. A permit will certainly be
granted under the major process. By your decision to insist on this, you are committing
the different agencies involved and yourself to countless hours and considerable
expense to review a "no-brainer".
I hope your system in the Division of Coastal Management gives someone in the chain
of command the latitude to use good judgement and common sense in mundane cases
such as this.
