may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-

land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they
have no objections to the proposed work.

It has come to our attention that a General Permit issuance by November 16, 2000 may be delayed by the timeliness of
return responses of the adjoining property owners. It is our understanding that the purpose of the "Certified Mail;
Return Receipt Requested" form was to minimize the public notice period.
The Town mailed property owner notifications on October 22, 2000. A copy of the certified mail receipts was provided
in our application documents, consequently, allowing 7 days for delivery, 10 days in hand and 6 days return mail, the
reasonable response period would end on November 13, 2000. This would allow for 3 working days to issue the permit
by November 16, 2000.
If our understanding of the above schedule is incorrect, please advise this office of the correct procedure for handling
public notice response.

other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then

from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by II" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

❑ About the Problem:
A breach in the primary frontal dune has occurred at the Wilson Avenue beach access boardwalk.
Recognizing both the environmental and public safety concerns presented by the eroded dune and its
ever increasing size, the Town desires to take effective remedial action as soon as possible. Since any
action to restore the primary sand dune must first be permitted through CAMA and vehicular access to
the beach front will only be permitted after November 15, 2000; the Town desires to aggressively
pursue the application process for a General CAMA Permit and be ready to initiate restoration
construction work efforts on November 16`h.
On October 16, 2000, the Town, Town Engineers and represSen4tatbves of CAMA inspected the Wilson
Avenue dune site. The Town proposed to PUSH the beach sand from high ground area along the
south side of the primary dune. The Town would'hire a front-end loader --and accomplish the work under
the direction of the Public Works DirectorTownEngineers and-CAMA inspectors. It is anticipated that
the restoration process would take abo 5 ys, eather permitting.
❑ Approach Methodology:
The Town has been advised that dune restoration accomplished by "PUSHING" sand from the beach
front would be accomplished under a GENERAL C"A Permit. Application for a General Permit
includes the following work efforts:
1. Letter of Request from Town
2. Narrative Statement describing project need
3. Issuance of "Letters of Permission" to all property owners fronting on the project site.
Include Certified Mail/Return Receipt Requested forms to all notified property owners.
4. Application Fee of $100.00.
Figure A illustrates the Project areas. The Town has instructed its consulting engineers, Ellinwood Design
Associates, Ltd. of Morehead City to prepare a Site Grading Plan, complete with construction and vegetative
stabilization specifications. See Plan Sheet C-1 attached hereto.
The general intent of restoration is to establish the 8.00 foot contour along the beach front as the "Toe of Slope"
and the 15.00 ft. contour as "Top of Restorative Fill". The north "Toe of Slope" will be contour elevation of
11.00 ft. The replenishment sand fill will be taken from the upper beachfront elevations between contours 6.00'
and 8.00'. The total area of disturbance is about 0.284 acres.

The general intent of restoration is to establish the 8.00 foot contour along the beach front as the "Toe of Slope"
and the 15.00 ft. contour as "Top of Restorative Fill". The north "Toe of Slope" will be contour elevation of
11.00 ft. The replenishment sand fill will be taken from the upper beachfront elevations between contours 6.00'
and 8.00'. The total area of disturbance is about 0.284 acres.

GENERAL PROVISIONS FOR PROJi-CT CONSTRUCTION
i. GENERAL
All construction shall conforr to the requirements and
dimensions on the construction plans, Engineer's Design
and Construction Standards, ,nd applicable Codes of the Town.
2, QUALITY OF MATERIALS
It is the intent of these Prcvisions to provide work efforts
materials free from defects in workmanship and product.

3. INSPECTIONS
The Contractor shall provide the necessary manpower and
equipment required as a part of the Inspection process.
The presence of the Engineer or Construction Inspector at
the work site shall in no way lessen the Contractor's
responsibility for conformity ofth the plans and
specifications. Should the En llneer or Construction
Inspector accept materials, oi• work that does not conform
with plans and specifications, whether from lack of
discovery or for any other reason, it shall In no way prevent
later rejection or correction,; to the unsatisfactory materials
or work when discovered. Thi Contractor shall have no
claim for losses suffered due to any necessary removals or
repairs resulting from the ursatisfactory work.
Any work which has been covt -ed without the
Construction Inspector's approval, shall, at the
Construction Inspector's regt.est, be uncovered and be
made available for inspection at the Contractor's expense.
Work performed before or after Town staff's normal work
hours or during the weekend or Town holidays shall
comply with the Town Code on,! shall include only such
tasks that do not require observation by a Construction
Inspector, unless previous arrangements have been made
for overtime with the Town Inspection Services.
4. CLEARING AND GRUBBING
The work of clearing and grubbing shalt consist of the
cutting, removal, and sotisfac Cory disposal of all vegetation
and all surface debris. Clearing and grubbing shall be
conducted in a manner to prevent damage to vegetation

The top 2 FEET of backfill material shall be free from stones
greater than 4 inches.
For all areas under a proposed roadway, the top 12 inches of subbase, and the
entire base course shall be compacted to a density of 100% maximum Standard
Proctor dry density as determined by AASHT❑ method T99, For that portion of
fill under roadways and extending at a slope of 1 to I beyond the back curb,
compact to a density of NO LESS THAN 95% of the maximum Standard Proctor dry
density as determined by AASHTO method T99, Fill material shall be placed in
lifts of 8 inches less of uncompected soil,
6. MAINTENANCE OF TRAFFIC
When Construction occurs in a traffic zone, traffic control devices must be
erected, maintained, relocated and removed in accordance with the plans,
specifications, NCDOT Supplement to the MUTCD, and the MUTCD.
The Contractor shall assume full responsibility for the continuous and
expeditious maintenance or replacement of all construction warning signs,
barricades, and other traffic control devices. The Contractor shall continually
review and maintain all traffic control measures to assure that adequate
provisions have been made for the safety of the public and workers. Failure to
maintain all traffic control devices in a satisfactory condition shall be cause
For suspension of construction operations until proper traffic control is re-
established.
7. PROJECT ACCEPTANCE PROCEDURES
All improvements Intended for public maintenance are eligible for acceptance by
the Town/Engineer fo(lowir)Q the pprocedures outlined below:
a. After the Installation of improvements in accordance with the
Town/Engineering Design and Construction Standards, and with plans approved by
the Engineer, the Owner/Developer or State the Construction
Inspector/Engineer shall schedule a final construction inspection.
b. The Engineer will respond with a punch list within 5 days after the
inspection.
c. The Owner/Developer/Contractor must complete all Items indicated on the punch
list, and any additional items noted, within 30 days
of the date of the final Inspection, or the punch list will be void. The
Owner/Developer/Contractor must then request another warranty inspection.
d. Upon the acceptable completion of all punch list items and payment of any
outstanding fees, the Owner/Developer/Contractor will receive an acceptance
letter from the Engineer. This acceptance begins a warranty for materials and
workmanship of not less than 1 year in duration from the date of acceptance.
The warranty will be to the Town from the Owner/Developer or Contractor.
e. Sixty days before the end of the warranty period, the Owner/Developer or
designee shall request a final inspection from the Engineer/Town.
f. The Engineer will respond with Final acceptance or a punch list on
workmanship or materials within 10 days after the Inspection.
9. The Owner/Developer or Contractor must complete all items indicated on the
punchlist, and any additional items noted, within 30 days or the punch list will
be void. The Owner/Developer or Contractor must then request another final
Inspection.
h. Upon the acceptable completion of all punch list items, the Owner/Developer
or Contractor will receive a letter of acceptance from the Engineer.
Until a letter of final acceptance has been Issues, all materials and
workmanship are the responsibility of the Owner/Developer/Contractor
