It is our understanding that the purpose of the "Certified Mail; Return Receipt Requested" form was to minimize the public notice period. The Town mailed property owner notifications on October 22, 2000. A copy of the certified mail receipts was provided in our application documents, consequently, allowing 7 days for delivery, 10 days in hand and 6 days return mail, the reasonable response period would end on November 13, 2000. MAINTENANCE OF TRAFFIC When Construction occurs in a traffic zone, traffic control devices must be erected, maintained, relocated and removed in accordance with the plans, specifications, NCDOT Supplement to the MUTCD, and the MUTCD. The Contractor shall assume full responsibility for the continuous and expeditious maintenance or replacement of all construction warning signs, barricades, and other traffic control devices. The Contractor shall continually review and maintain all traffic control measures to assure that adequate provisions have been made for the safety of the public and workers. Failure to maintain all traffic control devices in a satisfactory condition shall be cause For suspension of construction operations until proper traffic control is re- established. 7. PROJECT ACCEPTANCE PROCEDURES All improvements Intended for public maintenance are eligible for acceptance by the Town/Engineer fo(lowir)Q the pprocedures outlined below: a. After the Installation of improvements in accordance with the Town/Engineering Design and Construction Standards, and with plans approved by the Engineer, the Owner/Developer or State the Construction Inspector/Engineer shall schedule a final construction inspection. b. The Engineer will respond with a punch list within 5 days after the inspection. c. The Owner/Developer/Contractor must complete all Items indicated on the punch list, and any additional items noted, within 30 days of the date of the final Inspection, or the punch list will be void. The Owner/Developer/Contractor must then request another warranty inspection. d. Upon the acceptable completion of all punch list items and payment of any outstanding fees, the Owner/Developer/Contractor will receive an acceptance letter from the Engineer. This acceptance begins a warranty for materials and workmanship of not less than 1 year in duration from the date of acceptance. The warranty will be to the Town from the Owner/Developer or Contractor. e. Sixty days before the end of the warranty period, the Owner/Developer or designee shall request a final inspection from the Engineer/Town. f. The Engineer will respond with Final acceptance or a punch list on workmanship or materials within 10 days after the Inspection. 9. The Owner/Developer or Contractor must complete all items indicated on the punchlist, and any additional items noted, within 30 days or the punch list will be void. The Owner/Developer or Contractor must then request another final Inspection. h. Upon the acceptable completion of all punch list items, the Owner/Developer or Contractor will receive a letter of acceptance from the Engineer.
