Cohey, Jr., Secretary Director August 28, 1992 Mr. Whit Patterson Albemarle Bulkheads 507 First Street Kill Devil Hills, NC 27948 Re: Puhlick Bulkhead Dear Mr. Patterson: General Permit #10047-A was issued o Mr. Tianuhli�r (property owner) and Mr. Mike Bowling (houseontractor) for the construction of a bulkhead at Lot 154, S. Albacore St., in Hatteras Colony, Avon, Dare County. The bulkhead alignment was staked such that along the canal the bulkhead could extend into the water as far as 2 ft. However, along the basin side, the alignment was pulled behind a 1-2 ft. fringe of coastal wetlands along portions of the alignment. Such an alignment is common in the canal systems of the outer banks where marsh fringes have colonized the land/water interface. Mr. Patterson, as an experienced bulkhead contractor you have seen and had to work with similar bulkhead alignments in the past. As the bulkhead contractor for the Puhlick project you were responsible for constructing the bulkhead along or behind the staked alignment without severely impacting the wetland fringe. On two site inspections on August 6, 1992 and August 26, 1992 I found that all of the fringe marsh, including the root mat, had been dug up or washed out. Such impacts to the wetlands are a violation of the General Permit conditions Title 15A: 07H .1100. Typically, the alignment that is staked is the most waterward distance that the bulkhead is allowed. If your construction methods are such that you are unable to put the bulkhead along that line without impacting the wetlands, then you need to build it well behind that line to avoid wetland impacts. Along the same canal in Avon there are bulkheads that were constructed without severely impacting the wetland fringe. Because of the small area of wetlands lost and because I do not feel that the property owner should be held responsible for your sloppy construction methods in this case, I am not going to pursue a violation at this time. However, this letter should serve as a strong warning that future losses of wetland fringe due to poor construction methods will not be tolerated and a Notice of Violation will require full restoration of the impacted area as well as a civil penalty against you and the property owner. Cobey, Jr., Secretary Director October 6, 1992 Mike Bowling Construction 220 Lancer Court Kill Devil Hills, NC 27948 Re: State General Permit #10047A Dear Mr. Bowling: On July 29, 1992 General Permit #10047A was issued to you and Mr. Dan Puhlick for the construction of a bulkhead on Mr. Puhlick's property at Lot 154, S. Albacore Street, Hatteras Colony, Avon, Dare County. You wrote check No. 724 from The East Carolina Bank of Nags Head, to cover the application fee for the permit. That check was returned twice because of insufficient funds in your account. We now request a certified check or money order for $50.00 to cover the application fee. Failure to comply with this request will result in legal action from the State Attorney General's Office. Please forward a certified check or money order to this office as soon as possible.
