Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Based upon information brought to the attention of the Division of Coastal Management, it appears that the adjoining property owner and husband Bill Hughes did not sign the Adjacent Property Owner notification and waiver form that you submitted for issuance of the General Permit, nor was notification given to the Hughes' prior to your obtaining the permit. Under these circumstances, the Division of Coastal Management is suspending CAMA General Permit No 36899-D. The permit will remain suspended until the Division determines that the issues regarding the proper notification have been resolved, as per 15A NCAC 7H .1202(b)(2). At that time, the Division will re-evaluate the permit decision, and determine whether or not the permit could have been authorized under the provisions of the General Permit. The Division requests that you notify Mr. Mrs. Hughes, via certified mail, and provide them with a work plat drawing that illustrates the location and dimensions of the proposed pier and dock at the property located at Lot 7-A in Varnamtown. You must also notify them that any objections or comments should be provided in writing to the Division of Coastal Management. To facilitate this, I have enclosed the Division of Coastal Management Adjacent Riparian Property Owner Notification / Waiver Form. I did not sign this form and would not have signed because the property belongs to my wife. To the best of my recollection Sammy dropped a similar form (copy attached) off at my workplace on 2/11/05. 1 was not present, but did speak with him on the phone and told him my wife owned the property. After I met with Mr_ Jones, from your department, my wife mailed the waiver back with our concerns; simply due to insufficient dimensions being provided,. please note that the date on the waiver you obtained is prior to the date Sammy dropped off our copy. After discussing this with my wife last night, and numerous other people, there is an Obvious outrage concerning this. i had considered Sammy a friend until this point and was working towards addressing normal questions and concerns we may have had. Speaking on behalf of my wife, who has fears reaching beyond this, we wish to contest any permits that have been issued while we decide which direction to take.
