Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

Attached is General Permit #41723C- to construct a 100' x 5' dock, with (2) 6' x 6' jet ski lifts,
and (1) 20' x 10' platform at lot 43 and lot 60 at Magen Bay in Cape Carteret NC.
In order to validate this permit, please sign all three (3) copies as indicated. Retain the white
copy for your files and return the signed yellow and pink copies to us in the enclosed, self-
addressed envelope. If the signed permit copies are not returned to this office before the initiation
of development, you will be working without authorization and will be subject to a Notice of
Violation and subsequent civil penalties.

In regard to concerns over the request from Misters Timmins and Thompson to install
a shared dock and tvvo lifts, I have sorne concern. I need to make certain that I protect
my ability to also install docks and lifts on both lots 61 and 62. 1 don't want to get
"pinched out" in the small bay area. The 90 degree riparian rights are defined when
dealing with a deep water channel but seem vague when dealing with a shallow bay. One
of my questions deals with the point at which to extend the property line. Is it from the
shoreline, wetlands line, marsh and water line or the property line? Also, are the pilings
required for the installation of a boat lift subject to the 15' setback requirement?
I am not in any way trying to prevent my neighbors from reaching and enjoying the
water, I am simply concerned about my ability to dock both lot 61 and subsequently lot
62 in the future. I am confident we can reach an amicable solution.
