Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Ross Jr., Secretary April 12, 2005 Mrs. Rhonda Midgett 123 West Old Cove Road Nags Head, NC 27959 Re: Objection to the Issuance of CAMA General Permit No. 41009-A Development Project, Location, Dare County Dear Mrs. Midgett: This letter is in response to your objection as an adjacent riparian property owner to a permit request from Mr. Paul Thompson for the installation of bulkhead in Nags Head, Dare County. Mr. John Cece of the Division of Coastal Management staff was recently on site to evaluate the permit applicant's request. The permit applicant has requested a permit to install 92 feet of vinyl bulkhead at 4606 South Cobia Way, in Nags Head, Dare County. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H .1100. You have notified the Division of Coastal Management of your objections to this proposed development during two site visits conducted by Mr. Cece. Your objections to this proposed development related to the use of dock area adjacent to the corner of the canal where your property and Mr. Thompson's property meet. Mr. John Cece has reviewed your objections, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. As Mr. Cece explained to you during his site visit on April 11, 2005, General Permit No. 41009-A only authorizes the installation of 92 feet of vinyl bulkhead, it does not authorize the construction of a dock on Mr. Thompson's property. Should Mr. Thompson desire to build a dock in the future he will be required to notify adjacent riparian landowners prior to applying for another permit through the Division of Coastal Management. Your objections related to the use of dock area adjacent to your property can be addressed if and when Mr. Thompson applies for a permit to construct a new dock on his property.
