John Cece of the Division of Coastal Management staff was recently on site to evaluate the permit applicant's request. The permit applicants have requested a permit to replace an existing concrete bulkhead with 55 linear feet of vinyl bulkhead and realign existing riprap waterward of the new bulkhead. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H .1100. You have notified the Division of Coastal Management of your objections to this proposed development by fax. Your objections to this proposed development related to the placement of the riprap waterward of the proposed bulkhead. John Cece has reviewed your objections, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. Section I I05(b)(2) of 15A NCAC 07H states, "Where there is an existing bulkhead structure, riprap shall' be allowed to extend a maximum of 10 feet offshore. This location standard shall take into consideration the height of the area to be protected (i.e., bulkhead height, water depth) and the alignment shall allow for a slope no flatter than 2 feet horizontal per 1 foot vertical and no steeper than 1 '/2 fee horizontal per 1 foot vertical." Kimberly Hedrick, of the Division of Coastal Management staff, was recently on site to evaluate the permit applicant's request. The permit applicant has requested a permit to construct a pier 84-ft. long by 6-ft. wide with a 16-ft. long by 16-ft. wide platform at the waterward end of the pier, and a 14-ft. long by 12-ft. wide boatlift west of the platform. The structure will extend 100' waterward of normal water line (NWL). Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H .1200. You have notified the Division of Coastal Management of your objection to this proposed development by checking off that you have an objection in your riparian property owner notification/objection form and by letter. Kimberly Hedrick has reviewed your objection letter, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. The above referenced Subchapter allows for structures, as described above, to be built over the waters of Albemarle Sound, provided that the permit applicant meets and complies with all of the application prerequisite conditions. This includes the construction of a pier with a boatlift and platform, provided that they comply with the specific conditions of Subchapter 07H.1200. These rules specifically allow for 400 square feet of platform and 400 square feet of boathouse/lift. The proposed pier structure will have a 256 square ft. platform and 168 square ft. boatlift. This rule also allows for piers to be constructed up to 200-ft. in length, so long as they do not interfere with a known navigation channel or extend beyond one-fourth of the water body width. The proposed pier structure will extend 100ft. in length into Albemarle Sound. The Jordan's have a lot that extends further south into Albemarle Sound than your lot. They positioned their home more than 75 feet landward from normal waterline (NWL) at their bulkhead. According to our rules, they potentially could have, under our minor permit process, positioned their home up to 30 feet landward from the NWL. If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the Division of Coastal Management within 20 days of the permit issuance date.
