Statement of Compliance and Consistency This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certifythatthis project is consistent with the North Carolina Coastal Management Program. Thomasson 1765 Village Point Road SW Shallotte, North Carolina 28470-5584 Dear Mr. Thomasson: IVIUl UOP,ad It a This letter is in response to your correspondence received by the Division of Coastal Management on April 19, 2005, regarding your concerns about the proposal by McKee Pigott to construct a bulkhead adjacent to the Atlantic Intracoastal Waterway, at 1759 Village Point Road, SW, near Shallotte, in Brunswick County. The project consists of the construction of a wooden bulkhead landward of normal high water and landward of Coastal Wetland vegetation. The proposed project has been determined to comply with the Rules of the Coastal Resources Commission (71-1.1100), and as such, a permit has been issued to authorize the development. I have enclosed a copy of the permit, as well as, the relevant statutes. If you wish to contest our decision to issue this permit, you may file a request for a Third Party Hearing. The request for a hearing will be considered by the Chairman of the Coastal Resources Commission. The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) days after the disputed permit decision is made. Pigott Bulkhead Comments: April 18,2005 FOR THE RECORD We would oppose any redirection of runoff on to adjoining property caused by backfilling or other land disturbances In conjwiction with construc:tioll of proposed bulkhead. 2. We would oppose any acceleration of erosion on adjoining property caused by the eddN ing effect in the area of [tie wingwall at the end of the bulkhead. We have explored the possibility of a Rip Rap breakwater on the adjoining property and would share the conclusion that we are leaning toward at Lids Lime that a breakwater would better serve in this area than a bulkhead . We also recognize that a properly constructed bulkhead is much more to be desired and will be more durable than a retainer wall style ofconstruction. We appreciate the opportunity to comment for the record.
