This letter is to inform you that our homeowners' association Board of Directors has approved the installation of "topless" boatlifts in slips at our docks in the Trent River and "elevator" boatlifts at docks along the adjacent canal. Enclosed is a copy of the boatlift policy that was distributed to owners on April 23, 2004, as well as a drawing illustrating the locations of the docks. Very Truly Yours, C��` Ie Edward Kerl, President Olde Towne Townhouse Owner's Association Boat Lift Policy This policy allows a unit owner to place pilings and a boat lift mechanism in the slip already assigned by the owner's association. All costs for installation, power, etc. are to be paid by the owner. According to the Restrictive Covenants of the Association, any approval by the Architecture Committee of a structure over the water is considered to be done under a revocable license granted by the Association. 1. Approval by Architectural Committee is required of all proposed boat lifts. 2. Boat lifts must be "low -profile" lifts with no overhead framing or cables. 3. Lifts must be attached to pilings installed by the unit owner, completely independent of the HOA's docks and pilings. 4. The Architectural Committee must approve any modification of HOA docks, wharves, pilings or finger -piers. 5. Boat lifts must be uncovered. 6. All costs to be borne by the unit owner, including those for modifications to existing HOA-owned docks or piers. 7. CAMA permits and building permits, as may be necessary, to be secured and paid for by unit owner. S. Power to boat lift at unit owner's cost. 9. A legal instrument shall be executed between the Association and the unit owner, permitting the installation of a lift in the slip. The instrument will set forth the conditions by which permission has been granted for the installation of the lift and that the removal of the lift, if desired by the current or future owner, is the responsibility of the unit owner.
