The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . State Project # DF11503.4010012, $250 Debit Work Order Please find enclosed a plan sheet, permission letters and adjacent property owner notifications that are required for the application of a CAMA General Permit 1700. During Hurricane Ophelia, approximately 150 feet of SR 1888 was washed out on the east end of Ocean Isle Beach in Brunswick County making the road impassable. The North Carolina Department of Transportation (NCDOT) is therefore requesting authorization to repair existing sandbags at this location and place an additional 160 feet of sandbags along SR 1888 (Second St.) as shown on the plan sheet. The repairs and additional sandbags are necessary to rebuild the road back to its preexisting condition within the 60 ft. of Right of Way. We have provided a method of debiting $250 to be submitted to CAMA for processing the general permit, as noted in the subject line of this application. We are also requesting by copy of this application, authorization under GP 48 from the U.S. Army Corps of Engineers. In your request you also state that the DOT would like to shift the sandbags landward towards the R/W. It is our determination that the repair of the sandbag structure within or landward of the existing footprint and the repair of the R/W is allowable under maintenance and repair of an existing structure. Please be aware that the sandbag structure must not exceed its originally permitted length of 160'. The sandbag structure must also not exceed 20' in width at any point and 6' in height as measured from the bottom of the lowest bag to the top of the highest bag. Also be reminded that the DOT is responsible for the removal of remnants of all or portions of any damaged sandbags. The sandbag structure must be removed within 5 years after the date of its original approval. In this case, the sandbag structure was authorized on October 6, 2005 and therefore may remain in place until October 6, 2010. Timpy" <David.L.Ti npy(d,)saw02.usace.army.mil> Stephen and Brad Attached are pictures of a sand bag project that was constructed in October 2005 after Ophelia washed out the eastern end of Second St. (SR 1188) on Ocean Isle. This project was constructed under CANA GP 1700 and USACE GP 48. The first picture dated 4/07 is the completed project after the Corps renourished the beach and the Town of Ocean Isle covered the bags and vegetated the dunes. The second picture dated 1/08 shows the site in its current state. Bags have been dislodged, dunes and road are washed away. Per the Town of Ocean Isle, they have acquired permission from CANA (Debbie Wilson) to rebuild their section of the bags adjacent to their property which leaves -150 ft of bags adjacent to NCDOT R/W that would need rebuilding. Prior to the beach renourishment and covering of the bags the Department repaired and replaced some damaged bags. Your agencies considered this maintenance of an existing structure and did not require the Department to acquire another permit. My questions is this, can we rebuild this structure under maintenance? The Department is considering shifting the bags a little closer toward the R/W, will this create any additional issues if are able to proceed under maintenance? will all dislodged bags that are currently buried or partially buried have to be removed? Also, it is very doubtful that these bags will be covered and vegetated by May 2008, what will happen at this point? I know we can't resolve this by e-mail, I just wanted to get everyone up to dated on where we have been and whats ahead. I have been told to make this happen as quickly as possible, therefore I will be calling each of you soon to discuss further.
