To Whom It May Concern:
I was told by Mickey Sugg and Jim Gregson that I could remain anonymous and that it
would expedite the process of removing the riff-raff put down illegally without a permit
at the vacation home of Roger Nice located at 132 Gull Drive, Sneads Ferry.
The reason I feel the obviously small rock needs to be removed is because when we have
big storms it will move and close the entrance of the basin, therefore making an economic
hardship on the commercial boats that moor there.
I am also surprised at all the violations going on undetected on the Nice's lot.
1. Clearing of the lot with nothing planted to stop the erosion from running in the
river.
2. The illegal back filling on the shore.
3. The poising of protected bushes and maritime grasses with chemicals.
We don't have as much of our shoreline that provides nursery for different species of fish
left. People who abuse and destroy it should have to restore it.
I am also enclosing a diskette with pictures of the violations on the Nice's property.
Pertaining to 132 Gull Drive:
1. Nothing should be put on the shoreline that can be moved by storms
2. All riff-raff put down illegally should be removed before Hurricane Season 2001
3. It should be understood, that anything put down that causes financial hardship to
its neighbors, should be the responsibility of the party causing the hardship

Dear Sir,
We have no objection to the Nice's having a rip -rap breakwater, providing its
design and installation is to accepted standards. It should hold up to handling what would
be expected in an open water situation such as on the New River.
Hundreds of truckloads of dirt were dumped behind the newly constructed sea wall
(bulkhead) the Nice's built in 1999, only to have Hurricane Floyd take out huge sections
of the pier and bulkheading. The newly placed fill dirt ended up in our marina basin and in
a shellfish lease that was totally destroyed. If the job had been done correctly, this damage
could have been avoided.
We built a new dock within 100 yards of Nice that extended 180 feet into the New
River. This dock was in deeper water and exposed to much more wind, but did not lose a
single board. A newly constructed bulkhead also survived fine.
After Nice lost his near -new bulkhead, he replaced it again with inferior
construction. He also dumped another 100+ loads of fill. There are NC building codes
that apply to such structures, but it seems Nice has no more concern for building codes
than he does permits. Nice's poorly built bulkhead and pier resulted in expense and
damage to others. In addition, Mr. Nice has made threats on neighboring property,
homes, and lives.
The current rip -rap as installed is totally worthless. With any significant storm, it
will most certainly roll down and into the marina channel, blocking access for over 100
boats, as well as effecting the pleasure and livelihood of many people. Just a small
northeaster this spring resulted in a good portion of the rip -rap coming down. A hurricane
will tear it all down and fill up our channel.
The Nice's should be required to remove every stone that was.placed illegally in
the water of the New River. Mr. Nice is legally responsible for the sub standard
construction of his pier, bulkhead, and rip -rap when they result in losses to others.
To prevent injury to others, NC DEHNR should be responsible for overseeing
construction that takes place in NC waters and ensuring that it meets accepted standards.
The US Coast Guard was just assessed a multi -million dollar settlement for not
responding to a mayday call that resulted in loss of property and He. This letter is a
mayday call from the tax payers of Sneads Ferry, NC.
