Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistentwith the North Carolina Coastal Management Program.

Dear Mr. Tyndall,
Having been referred to you by Mr. Brownlow we are submitting this request to the Division of
Coastal Management to immediately stop the permanent placement of the Mason/Brown
mooring.
We set forth two reasons for our objection to the currently marked site.
The first reason is the marker's orientation as set in the bay today does not reflect the position
as submitted.
The second reason is the position, beam of vessel and it's arc of swing will substantially block
our home's view of the water. A property appraisal performed by Ms Gayle Smy clearly states
the value to the property of it's water front and "clear view". See attached photo addendum
from the appraisal and photos taken 14 July, 2003. Loss of view and a vessel not your own
dominating the view from every window lends the property less desirable as waterfront thus will
depreciate the property value of the home. We are surrounded on all sides by designated
wetlands. We have no option.
We respectfully ask and plead that the Division hear us and visit our home in making it's
determination. We are permanent residents and have a tremendous investment here. Our
neighbors are not permanent residents. They are weekend and vacation owners and have no
sympathy in their impact upon our property. It cannot be fair that one who possesses the most
riparian rights be allowed to so severely impact the neighbor who has the least. Our water front
footage indicated on the survey is fifty feet. We are at a great disadvantage and are wholly
dependant upon goodwill and compromise. In addition the vessel to be moored is a multihull,
shallow draft and trailorable design. It offers many options of placement within their riparian
right.
We would like to explain the signing of the Adjacent Riparian Property Owner Statement
without presence of drawing and comment. Please notice on your copy the absence of a drawing.
When Mr. Mason came to our home and inquired as to our having objections to their proposed
mooring we expressed a willingness to "work cooperatively and in the same spirit in which we
and our other neighbor had done in our moorings." Subsequent to this we received an email
indicating attachment. When downloaded to screen and printed there was no drawing of
proposed location. We thought it an oversight. Because we did not sign on the proper line a
second copy was provided with signature. A second printing was void of a drawing. No mention
was ever made of the omission on their copy. We had been acting under impression it would be
forthcoming or they would contact us when a marker was dropped. We have advised them of
this mistake and made apology. Despite this there is no willingness to compromise. It would be
an unconscionable act to misuse this honest mistake, hide behind it and proceed.
In closing we will be redundant and say that we do not object to a mooring, only it's placement
as marked by the existing float.

Dear Mr. Tyndall,
This is in reference to email I sent to Mr. Brownlow and has been sent to you.
I wish to make it clear that there does not exist an objection to a
mooring. I agreed to the project and orally stated that we are most happy
to work with them in the same spirit we had done with our and our
neighbor's mooring. We only ask sensitivity to final placement and it's
impact upon our home. We feel that we have compelling reasons that are not
outrageous and worthy of consideration. It was my concern that no restraint
will be made, the mooring will become permanent and our concerns go unheard.
