Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Box 342 Buxton, NC 27920 Dear Mr. Farrow: This letter is in reference to your April 29, 2003 correspondence (copy attached). As an adjacent riparian property owner you registered your objection to a permit request from Anthony Lane, Jr. of Lot 1B, Ethan's Way, Buxton, Dare County, to construct a pier off the shoreline of his property, at this same location along the shoreline of the Pamlico Sound. Dennis W. Hawthorn, a Coastal Management Representative from this office, was recently onsite, and has reviewed Mr. Lane's proposal to construct an elevated walkway, pier and platform. Mr. Hawthorn noted that this walkway will extend from high ground on Mr. Lane's property across approximately 455 feet of coastal or other wetlands. The pier will extend 90 feet beyond the shoreline of the Pamlico Sound, and will include a 10 feet long by 20 feet wide platform at the end of the pier structure. Mr. Hawthorn reviewed all aspects of this proposal for consistency with 15A NCAC, 07H .1200. This statute describes the rules and guidelines that apply to the placement of walkways, piers and platforms within the permit jurisdictional areas that are associated with the Pamlico Sound in the vicinity of this project. Mr. Hawthorn has also reviewed your letter stating your concerns and objection to Mr. Lane's proposal. A pier of one hundred feet in length is commonly permitted within the sounds of this region to allow access by vessels to mooring facilities along shallow - water shorelines. The setting of fishing nets in this area would not be precluded by the placement of a pier, and limited bottom disturbance in the vicinity of the pier is a temporary impact that is tolerated when water -dependent development is undertaken. This review has found the proposed development to be consistent with NCAC Section 07H .1200. 1367 U.S. 17 South, Elizabeth City, North Carolina 27909 Joseph Farrow, Jr. May 20, 2003 Page 2 The staff of the Division of Coastal Management has given your objections to this proposal careful consideration. We have determined that the proposed project is consistent with the appropriate rules and regulations and that all pre -requisite requirements have been satisfied. In this regard, the Division intends to issue General Permit # 33712-A for the proposed development on May 21, 2003 (copy attached) for the proposed development. If you wish to appeal this permit decision, you must file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within 20 days of the permit issuance date. It would impact boating and other water uses in this area. Fishermen set their nets in this area and it would also effect ingress and egress to my boat dock located in my canal area.
