RE: Objections to the Issuance of General Permit on Dowdy Lane,
Kitty Hawk, in Dare County
Dear Messrs. Tillett and Tillett:
This letter is in reference to your meeting with Lynn Mathis on April 2, 2002, regarding a pier under
construction by R. A. Hoy, Dowdy Lane, Kitty Hawk Dare County. The Division of Coastal Management reviewed
the proposal and found it consistent with T15A, Section 07H .1200: General Permit for Construction of Piers;
Docks; and Boat Houses in Estuarine and Public Trust Waters (Enclosed), and issued General Permit #33041A, to
Robert and Michelle Hoy on March 31, 2003 (See Enclosed Permit).
It has since come to our attention that the pier may partially cross a small navigation channel. On -site
inspection has revealed that while a slight change in depth occurs along the outside edge of the approved boat slip
alignment, it is not known whether the location constitutes "unreasonable interference with navigation or use of the
water." If it is determined that the pier unreasonably interferes with navigation Mr. Hoy will be required to correct
or remove any inconsistencies. Mr. Hoy has agreed to stop work on the pier at this time, pending a resolution that
My include pulling the alignment in approximately 10 feet. This letter is to keep open your options, as you have
requested to Ms. Mathis.
If you wish to appeal this permitting decision, you may file a request with the Director of the Division of
Coastal Management, Department of Environment and Natural Resources within twenty (20) days of the permit
decision. If you have any questions regarding this matter please do not hesitate to contact me in the Elizabeth City
