Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

This tter is in reference to your returned riparian notification letter dated March 3, 2003
indicating yourobjection to a proposed bulkhead and dock replacement by Mr. Harrel L. Gallop,
Jr. on his property located at 137 Davis Landing Road, Wanchese, Dare County. You have
indicated that you do not wish to waive the 15 ft. setback requirement for piers, docks, mooring
pilings, breakwater, boat houses or boatlifts. The development structures proposal does not
include any of the aforementioned structures to be located within 15 ft. of your riparian property
line.
Therefore, the Division of Coastal Management has given your objection careful
consideration and has determined that the project as proposed is consistent with the appropriate
rules and regulations and that all pre -requisite requirements have been met. Consequently, the
Division issued a general permit (copy attached) on March 21, 2003 to Mr. Harrel L. Gallop, Jr.
for bulkhead and dock replacement.
If you wish to appeal this permit decision, you may file a request with the Director of the
Division of Coastal Management, Department of Environment and Natural Resources within 20
days of the permit decision. If you have any questions regarding this matter you may contact me
in the Elizabeth City Field Office at 252/264-3901.
