Statement of Compliance and Consistency
This Permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Re: John Fleming and Barbara Reardon Bulkhead Permits

Dear Mr. Morrison:

Thank you for your letter that we received on August 6, 2003. This letter, appears to refer to
correspondence you received from Barbara Reardon, an adjacent riparian property owner with a
title claim to a private easement through, or adjacent to your property, and to correspondence
received from Mr. John Fleming, who is your adjacent riparian neighbor directly to the south.
The purpose of the correspondence sent to you from these permit applicants was to notify you of
their intentions to construct a bulkhead and steps within this easement along the Fleming
shoreline. This notification process is a pre -application permit requirement of our rules
concerning the issuance of CAMA General Permits. These permit requests and the location of
this work were reviewed by Mr. Dennis Hawthorn, of this office.
The Reardon and Fleming bulkhead alignment will be aligned approximately 10-feet landward
of your current bulkhead alignment, and will tie into your bulkhead. The bulkhead alignment -will
extend approximately 100-feet south along the shoreline, and will continue with the Samuel L.
Peluso bulkhead alignment, the adjacent riparian neighbor to the south of Mr. Fleming's
property. Ms. Karen Fleming, daughter and agent for M. Fleming, has applied for Mr. Fleming's
permit on his behalf. These bulkhead structures will be aligned approximately 1 to 2-feet
landward of the existing NWL (normal water level, i. e., shoreline), slightly landward of the
existing erosion escarpment, closest to the shoreline. Ms. Fleming and Ms. Reardon has verbally
informed Mr. Hawthorn that Ms. Fleming will be responsible for the construction of the
bulkhead alignment across the private easement. Ms. Reardon has also proposed to place a set of
steps within this easement. These steps will be 5-feet wide and 6-feet long. They will be placed
10-feet from the shoreline, and will not intersect the shoreline, or extend into the water.
We have noted in your correspondence sent to this office that you have indicated you object to
the placement of Ms. Reardon's bulkhead across her easement and steps within this easement.
However, you have attached a letter that states "distinct reservations" for "any construction along
the shoreline of properties owned by me and John Fleming, other than a bulkhead to be erected
sometime in the near future on the Fleming property, contiguous with the bulkhead on my
property".

Mr. Hawthorn was recently onsite, and has reviewed these construction proposals to build the
above described shoreline stabilization structures, as well as the proposed set of steps within the
Reardon easement. During the permit review process, Mr. Hawthorn discussed this project with
the applicants. A close examination of the Reardon's bulkhead alignment has found that the
proposed alignment is consistent with your request, and is also consistent with our rules found in
15A NCAC 07H .1100 and 07H .1200.
The Division of Coastal Management has given your objections to this proposal careful
consideration, and has determined that the proposed project is consistent with the appropriate
rules and regulations, and that all pre -requisite requirements have been satisfied. In this regard,
on August 15, 2003, the Division issued General Permits Nos. 33898-A and 33900-A (copies
attached) for the proposed development.
If you wish to appeal this permit decision, you must request the appropriate application forms,
and file a request with the Director of the Division of Coastal Management, Department of
Environment and Natural Resources within 20 days of the permit decision (August 15, 2003).
