This permit is subject to compliance with this application, site drawing
and attached general and specific conditions. Any violation of these terms
may subject the permittee to a fine, imprisonment or civil action; and
may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-
fies by signing this permit that 1) this project is consistent with the local
land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they
have no objections to the proposed work.
In issuing this permit the State of North Carolina certifies that this project
is consistent with the North Carolina Coastal Management Program.

Attention: Ms. Linda Kenan
Following the receipt of your April 28, 2000 letter which arrived here in Amsterdam on May 4,
2000, where we are awaiting the arrival of our grandchild, I called your office to obtain some
clarification on the material you sent. I do appreciate your returning my call the same day.
Based on our conversation, it is my understanding that Mr. Ed Mochel, my adjoining neighbor,
has a contingency contract for the sale of his property at 114 Teak Ct. The affixed contingency for
this sale is obtaining the necessary approvals for the construction of a new boat dock 20 feet long
and 6 feet wide with an adjoining boat lift. At the present time Mr. Mochel has a boat dock
without a lift located at a different location. He is not requesting any waiver to the 15 foot
setbacks from the existing property lines.
Since becoming a permanent resident at 112 Teak Ct. on December 1, 1996, it has been my
observation that Mr. Mochel has been a very infrequent visitor to his property, staying less than a
week, perhaps twice a year. While I can appreciate Mr. Mochel's personal interest in obtaining the
necessary approvals for the referenced construction, he has not considered what occurs within the
proposed construction area without living here full time. The proposed construction location will
protrude out into the channel of the canal that serves as the main entrance and exit from the Davis
Boat Landing ramp. This ramp gets considerable usage. The water area where Mr. Mochel
proposes the new construction is presently utilized by boaters to maneuver their boats for docking
to present mooring locations; turning around since some boats are too big to pass under the bridge
at Mimosa Blvd., and stacking up while awaiting access to the boat ramp. I don't feel Mr. Mochel
is aware of these situations.
With the proposed size of the dock and lift extending out from the shore line approximately 14
to 16 feet, a blind spot will be created between the main channel and the Davis Landing Channel.
This is a serious and critical situation. With the construction located elsewhere, the potential for a
serious accident can be avoided. I am a boat owner and do moor my boat at a dock smaller than
the one proposed, but I do not have a lift. As such we do have some true- to- life experiences at
this location.
Based on the foregoing observations, I do not support the construction of the boat dock and lift
at the proposed location and request this disapproval be duly recorded. I do not have any objection
to having a new dock/lift constructed at the present dock location.
I will be back in Pine Knoll shores on May 22, 2000 if anyone wishes to discuss my position on
this objection.

Carol gave me your address after I explained why I needed to get in touch with you.
I have listed Ed Mochel's house at 114 Teak Court. I also have it under contract. The Buyer is seeking a
CAMA permit to install a new dock and a boat lift. It does not require waiving of 15' setback (see
proposed diagram). According to CAMA regulations the adjacent property owners must be notified and
given the opportunity of signing off on it. Since you were not home, I followed the notification "by return
receipt requested" specifications. Then I saw Carol and got your address. If you do not respond the
permit will be issued in ten days. If you choose to respond the address is on the enclosed form.
