may subject the permittee to a fine, imprisonment or civil action; and
may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-
fies by signing this permit that 1) this project is consistent with the local
land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they
have no objections to the proposed work.
In issuing this permit the State of North Carolina certifies that this project
is consistent with the North Carolina Coastal Management Program.

The property referenced above is owned by Mr. Richard M. and Mary B. Tallman, 755 Haws
Run Road, Jacksonville, NC 28540. The Tax Map and Parcel Number of the property is 421 - 2,17.
This property is currently zoned Residential Multi -Family 5 (RM-5). The lot is undeveloped and has
no structures other than a dock on the property.
It is my understanding that Mr. Tallman wishes to use the dock on occasion to place his crab
pots/traps when being emptied or stored. The RM-5 zoning district does not allow for commercial
use, however, a Home Occupation is a permitted use by right. The City views Mr. Tallman's
proposed use as an operation of a Home Occupation based on the following criteria:
• Only the resident will be working there.
• There will be not exterior evidence of the conduct of a home occupation.
• No on -site sale of goods or services not produced on the premises will occur.
• There will be no significant increase in vehicular or pedestrian traffic.
• There will be no requirement for additional off-street parking for clients or customers.
• There will be no training and sales promotion.
• There will be no increased garbage disposal.

The City shall have the right at any time, upon reasonable request, to inspect the premises for safety

Dear Ms. Barrett:
I received a waiver sheet and blueprints on Lot 3, Shoreline Estates from Mr. Richard M.
Tallman, Jr., 755 Haws Run Road, Jacksonville, NC 28540. His request is for me to
waive a 15-foot setback to my property, which is Lot 4.
Two days later I met with Mr. Tallman on the property and he explained to me what his
plans are for Lot 3—a covered boat slip, a concrete boat ramp and a privacy fence to
store crab pots. We had a long discussion and in my opinion its seems to me that this
would be a commercial venture. My concern is that this property is zoned residential.
I spoke with Mr. Bruce Payne who is the Jacksonville City Planner. I shared my
concerns with him and he stated he presently had nothing for any type of construction for
Lot 3 and he stated that the area is zoned for residential. I spoke to you, Ms. Barrett,
approximately 3:30pm on September 14 and you stated that there should be no problems
with him storing crab pots, but I personally believe that having a fenced -in area next to
my property is a problem due to sight and smell.
I wish to go on record that I am not waiving the 15-foot setback on my property, Lot 4,
because a construction to hold crab pots and a concrete boat ramp are a commercial
venture.
I have had numerous calls from other residents on Shoreline Drive that have the same
concerns as I share in this letter.
