This permit is subject to compliance with this application, site drawing
and attached general and specific conditions. Any violation of these terms
may subject the permittee to a fine, imprisonment or civil action; and
may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-
fies by signing this permit that 1) this project is consistent with the local
land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they
have no objections to the proposed work.
In issuing this permit the State of North Carolina certifies that this project
is consistent with the North Carolina Coastal Management Program.

Floyd's last visit. The removal will be from the East end of the gas dock, out approximately 30
feet, then southward to approximately marker 4, then westward to marker 3, and then northward
to the starting point. The shoal will be removed to a depth of approximately 6 feet. It is
estimated this will entail the removal of approximately 950 cubic yards of sand.

As we discussed on the phone earlier today, my firm is counsel for First Citizens Bank &
Trust Company in its role as trustee of property located adjacent to Spooners Creek Yacht
Club. This past week, my client received notification from Bruce Fetzer describing the
dredging project which he is proposing doing generally from the mouth of Spooners Creek to
the intracoastal waterway.
At this point in time, we are without sufficient information to determine whether we should
object to the proposed project or not in that the location of the area to be dredged along with
a cross-section of the proposed channel to be created has not been provided to us. The cover
letter provided by Mr. Fetzer gave the following description of the area to be dredged but no
drawings:
"The removal will be from the east end of the gas dock, out approximately 30
feet, then southward to approximately marker 4, then westward to marker 3,
and then northward to the starting point. The shoal will be removed to a depth
of approximately 6 feet. It is estimated this will entail the removal of
approximately 950 cubic yards of sand."
In light of the fact that we are without this information, we must therefore object to the
proposed dredging activity until we receive more information. The concern is over the
possible proximity of the dredging activity to my client's seawall that runs along the mouth of
Spooners Creek. It has been my client's position for a number of years that prior dredging
activities conducted by Mr. Fetzer have contributed, if not caused, the deterioration of this
portion of my client's seawall. As you know, my client is beginning the process of repairing
this portion of the seawall and has retained Chuck Bissette with T.D. Eure Construction to
oversee the project. We certainly do not want these needed repairs to be in vain.

In speaking with Chuck, he suggests that the bottom western edge of the channel which is
projected to be at a depth of six (6) feet at mean low tide be located in such a manner so as to
provide a slope ratio of 1:5 (rise/run in feet) to the seawall. Assuming that this setback and
slope ratio is incorporated into Mr. Fetzer's application or by your office in its issuance of a
permit, my client will withdraw its objection. I would appreciate it if you would give me a
call to discuss your thoughts on this type of restriction.
