Mr. Sparrow has an existing dock that is within 15 ft. of both adjacent property owners and is in a state of disrepair. The original proposal involved the removal of the existing dock; installation of a 6 ft. X 15 ft. dock at the bulkhead; and the replacement of the bulkhead within the existing alignment. Both adjacent property owners would have been required to waive the 15 ft. setback. While Mr. Szabo did in fact waive, Mr. Rose objected citing the proximity of the proposed dock would result in a portion of Mr. Sparrow's boat, when docked, would sit in front of Rose's property. Needless to say he refused to waive the setback. The proposal was amended to locate the side -to dock so that it would meet the minimum 15 ft. setback from the Rose property. I faxed the revised proposal to Mr. Rose Friday morning 6/16/2000 and requested his comments by Monday. To date I have received no response. As you can see this project came in the third week in May. Mr. Rose failed to return several messages that I left for him regarding the original proposal. His secretary finally gave me his mobile number last week and I was able to reach him. Foley & Foley are the contractors hired to install the dock and bulkhead. They will be submitting the permit fee later this week. Please let me know if you have any questions. The proposed project involves the replacement of the existing 30' bulkhead along the same alignment and the construction of a 6' wide by 14' long platform dock located 16' from the common property line. The North Carolina Division of Coastal Management has given your objections careful consideration and has determined that the project is consistent with the appropriate regulations of the Division including meeting the required 15' minimum setback. Consequently, the Division issued CAMA General Permit #25643-C to Mr. Sparrow on June 23, 2000. If you wish to appeal this permit decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within 20 days of the permit decision.
