The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . Ross Jr., Secretary Mr. Carl Bivens 1235 Highway 24 Newport, NC 28570 Dear Mr. Bivens: November 8, 2005 This correspondence is in reference to your August 18 and August 29 letters of objection letter to the bulkhead and pier proposals of Mr. Steve Smith, adjacent to the Neuse River at Lot 2, Section A, Sportsman's Village, Carteret County, NC. The applicants propose to install 97' of bulkhead landward of the existing riprap structure, and a 100' pier to an 8' x 16' T-Head dock. Because you state that you are writing representing yourself, and Mr. Fred Filsoof, as his agent, I am writing one response. It appears that your objection centers around two specific concerns: 1) The pier is a foolish and reckless endeavor, as exhibited by the lack of piers along this shoreline. 2) The bulkhead will divert water onto adjacent properties during storm tides, namely your property and that of Mr. Filsoof. The DCM reviewed the application along with the pertinent rules of the Coastal Resources Commission in conjunction with your objections and determined that the project is consistent with the Commission's rules. Therefore, the DCM issued CAMA General Permit #43198-C to Mr. Steve Smith, with acting agent of Noe Construction Services, on November 8, 2005, authorizing the bulkhead and pier project. If you wish to appeal this permit decision, you must file a Third Party Hearing Request with the Director of the Division of Coastal Management, Mr. Charles S. Jones, Department of Environment and Natural Resources within 20 days of the permit decision. A copy must also be sent to the Attorney General's Office, Environmental Division. The applicants propose to install 97' of bulkhead landward of the existing riprap structure, and a 100' pier to an 8' x 16' T-Head dock. Because you state that you are writing representing yourself, and Mr. Fred Filsoof, as his agent, I am writing one response. It appears that your objection centers around two specific concerns: 1) The pier is a foolish and reckless endeavor, as exhibited by the lack of piers along this shoreline. 2) The bulkhead will divert water onto adjacent properties during storm tides, namely your property and that of Mr. Filsoof. The DCM reviewed the application along with the pertinent rules of the Coastal Resources Commission in conjunction with your objections and determined that the project is consistent with the Commission's rules. Therefore, the DCM issued CAMA General Permit 443198-C to Mr. Steve Smith, with acting agent of Noe Construction Services, on November 8, 2005, authorizing the bulkhead and pier project. If you wish to appeal this permit decision, you must file a Third Parry Hearing Request with the Director of the Division of Coastal Management, Mr. Charles S. Jones, Department of Environment and Natural Resources within 20 days of the permit decision. A copy must also be sent to the Attorney General's Office, Environmental Division.
