We object to the proposed dock as Drawn because the drawing indicates that the distance between the dock on our lot (Lot 14) and the proposed dock for Lot 13 is 30 feet. To clarify any confusion, a Certified Marine Survey was conducted using literally hundreds of soundings (See Attachment 1). This marine survey is on file with Craven County, recorded in Plat Cabinet G, Slides 16 F—G. This survey dated, 17 May 1999, by Brad L. Suit & Associates of Lot 14, Lot 13, Lot 12, and part of Lot 11 very clearly indicates that we have 17.5 feet from the southernmost i!in (not dock, but piling) to the riparian line between Lot 14 and Lot 13. Therefore, we respectfully request that the closest that the northernmost piling for the dock on Lot 13 be no less than 32.5 (17.5 + 15.0 = 32.5) feet south of our southernmost piling. As you can see, we (Lot 14) are 17.5 feet off the riparian line and Lot 12 is 19.6 feet off the riparian line (See Attachment 1). With a 36 foot dock, this leaves Lot 13 with 31.3 discretionary feet. For the safety of all concerned, it would seem logical that the dock for Lot 13 be reasonably centered between the two existing structures. We appreciate your taking into account the results of the Certified Marine Survey when reissuing the permit for the proposed dock for Lot 13. Give me a call at 444-8448 to discuss. As best as we can determine, the proposed dock will be approximately 15 feet from the riparian line of the Holbert lot #1 12. The estimated distance from the Holbert dock to the Rei dock will be about 62 feet. I suspect that the distance could be as much as 4 to 8 foot greater but it is hard to tell from our perspective. The existing Pagett dock is over the riparian line by approximateiy i0 feet. The riparian line that we refer to is the one that was handed to me, Al Pagett and Dick Holbert on April of 1998 by Mr. Ted Tyndall and Mr. Scott Jones of CAMA. This is on file at the CAMA office in Moorehead City. If you add the 10 feet that the Pagett Dock is over the riparian line to the 15 foot setback, then the Pagett dock is in violation towards my side by approximately 25 feet. This means that if CAMA pernritts our dock 15 feet from the Pagett dock, we will be forced to give up 25 feet of water rights usage. in order for the Pagett dock to be in compliance, 25 feet of the dock will have to be removed. This situation does not even take into account the tie -off posts that are actually extend another 4 feet from the dock towards our side of the property. Please see the attached plan for a more detailed description on how we plan to build our dock.
