This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

This permit, issued on SEPTEMBER 8, 1995 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) Workplan drawing C2 was revised to depict the 15* sideline setback. This plan must be closely
adhered to unless waiver is later received with copy provided DCM.
2) The pier and associated structures shall have a minimum setback distance of 15' between any
parts of the structure and the adjacent property lines as extended perpendicular to the channel into
the water at the points where they intersect the shoreline.
3) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structures,
whether floating or stationary, may become a permanent part of this docking facility without
permit modification. No non -water dependent uses of structures may be conducted on, in, or
over public trust waters without permit modification.

This permit action may be appealed by the perminee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1998
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
4) The docking facility will display a sign showing the location of the nearest pumpout facility,
including other appropriate waste disposal information, at the entrance and exit from the main
pier.
5) No sewage, whether treated or untreated, shall be discharged at any time from boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.
6) The waterward limits of the authorized docking facility will be permanently marked with
reflective material to preclude collision by boats during periods of darkness or inclement weather.
7) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
K) The authorized structure and associated activity must not cause an unacceptable interference with
naviization.
NOTE: The permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this
requirement if he abandons the project without having the permit transferred to a third
party.
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan
must be filed at least thirty (30) days prior to the beginning of any land -disturbing
activity. Submit this plan to the Department of Environment. Health. and Natural
Resources, Land Quality Section, 1424 Carolina Avenue, Washington, NC 27889.

(1) Construction and installation of the 26 finger piers and associated mooring
piles must be accomplished in accordance with the permitted work plats.
(2) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction -
related discharge.
(3) Prior to occupancy of any new slips authorized under this permit, the permittee
will equip and maintain for the life of the marina a pumpout facility to
service boats with holding tanks.
(4) The marina shall promptly post and enforce a locked head policy for boats
without holding tanks at the main entrance to the marina.
(5) This permit authorizes only the docks, piers and other structures and uses
