Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

We own the property at 146 Hoop Pole Crk Dr, Atlantic Beach, NC, directly adjacent to
the Fuerst property. We received the request for adjacent owner's approval and after
initial approval, we withdrew our approval.
We first developed our property in 1979 and over the years, we have experienced almost
no erosion. After an onsite visit, we believe the result of this seawall would be to create
erosion on our property, eventually requiring that we build a seawall ourselves.
We do not wish to disturb the natural washing of the shoreline by building a seawall if it
is not needed and we believe the proposed seawall would force us to do so.
Enclosed is a copy of our letter to the Fuerst rescinding our initial approval.

Dear Bob,
I regret to inform you that I need to rescind my approval of a seawall to be built next to
our property at 146 Hoop Pole Creek Drive, Atlantic Beach, NC.
After an onsite visit, we believe the result of the seawall would be increased erosion on
our property, eventually requiring that we build a seawall on our property. Over the
years, we have experienced very little erosion and do not wish to disturb the delicate
balance of the shoreline.
I sincerely apologize for not visiting the site before giving my original answer. In my
hast to be an agreeable neighbor, I answered too quickly. I also regret any inconvenience
this might have caused.

This correspondence is in reference to your October 09, 2008 letter of objection to the bulkhead
proposal of Mr. Robert Fuerst, within Hoop Hole Creek, located adjacent to 144 Hoophole Creek
Road, in Atlantic Beach, Carteret County, NC.
The DCM reviewed the application along with the pertinent rules of the Coastal Resources
Commission in conjunction with your objections and determined that the project as proposed is
consistent with the Commission's rules. Therefore, the DCM issued CAMA General Permit
#52636-C to Mr. Julian Gilgo, on October 13, 2008, authorizing the bulkhead as proposed.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request with the
Director of the Division of Coastal Management, Mr. James Gregson, Department of
Environment and Natural Resources, within 20 days of the permit decision. A copy must also be
sent to the Attorney General's Office, Environmental Division. If you wish to appeal, please
contact me and I can forward you the pertinent forms. And if you have any questions about this
