Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. The property adjacent to the proposed site, 201 19th street, is now owned by LWM, LLC which is composed of the surviving heirs of the estate of Nancy Garvey. The letter briefly described the proposal and enclosed an "Adjacent Riparian Property Owners Statement" and an "Adjacent Riparian Property Owner Notification/Waiver Form" which you requested be signed and mailed back. We have a few questions regarding the proposal and would appreciate your response. 1) The letter contained no information regarding the purpose of the bulkhead project. Can you give us more information about the purpose and goal of the proposed project? 2) Can you provide an estimated height and lateral position (example: mean high water line) for the bulkhead? 3) The area proposed for the bulkhead currently contains the remnants of a concrete culvert drain system installed many years ago in an attempt to address runoff from Emerald Drive. The system failed soon after placement and has not functioned since. In the years before her death, my mother had requested that the town remove the concrete aprons which remained on the sound beach and which had become a severe hazard to recreational visitors. She was told that the system was the responsibility of the state highway department and there was nothing Emerald Isle could do. Can you tell me how the proposed bulkhead project will deal with the failed drain system and the concrete aprons? 4) The area proposed for placement of the bulkhead is currently highly eroded due to storm runoff from the paved and unpaved portions of 19th street. If a bulkhead is placed at the end of the street, what impact will that have on the stormwater runoff and will the bulkhead design ensure that future stormwater runoff will not adversely impact and erode our adjacent property? 5) Can you provide us with any engineering conclusions or information regarding the impact of the proposed bulkhead on erosion of existing natural marsh lands and natural riparian areas on the adjacent properties? 6) As you are aware, the end of 19th street is a CAMA "Local Access Site," with no parking available. We assume that the bulkhead structure will result in a "wall" at the end of the street with adjacent wing walls as depicted in the draft drawing of the proposed project. Can you describe the accommodations that will be made to allow safe pedestrian access over the structure? Also, are there any provison in the plan to preclude trespass onto the adjacent private properties? We are generally supportive of the Town's efforts to improve and maintain public trust water access for the shorelines in Emerald Isle. We are concerned that the Town ensure that those actions do not adversely impact existing natural environments, compatible public uses and the rights of adjacent property owners. Finally, the Division of Coastal Management, "Adjacent Riparian Property Owner Notification/Waiver Form" that was received with the letter was for a proposed permit at the "north end of 23rd street." We assume this was in error and would need a corrected copy of that notification in order to respond. Thank you for your time and response.
