Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Please find enclosed the set -back certification per your request. We are happy to waive
the setback requirement to ten (10) feet. As we discussed previously, you were of the
opinion that if you were to encroach on the required setback, it would be no more than a
few feet. The grant of five (5) feet should provide you with the space you need to
complete your project, while ensuring that, given the location of the sandbar, we have the
appropriate space for ingress and egress from our property.
I apologize for the miscommunication regarding the need of this certification. I hope that
this provides you with what you need to complete your project. I would be happy to
speak with you or members of the County Planning Staff regarding this matter if it would
be helpful. Feel free to call me to discuss if the enclosed does not meet your needs, as we
wish to assist you in whatever way we reasonably can.
