JdPi 1 2005 Coro C' The existing overhead electric line along NC Highway 12 through the Lake Mattamuskeet Wildlife Refuge must be rebuilt. This line serves the homes and businesses on Cedar Island. NC Highway 12 and the electric line are within an easement the US Government granted years ago. The electric line will be rebuilt along the shoulder of Highway 12 within this easement. None of the proposed construction will place any electric line facilities in the waterway. However, because of the proximity to the existing canal, I am seeking your guidance. Mr. Bruce Freske, Manager of the Refuge, and the NC Department of Transportation have been involved in this project. Mr. Freske stipulated that all construction be within the aforementioned easement granted by the US Fish and Wildlife Service. The NCDOT executed an encroachment agreement for the electric line rebuild. A copy of the plans, the NCDOT encroachment agreement, and correspondence from Mr. Freske are enclosed. Please review the attached plans and let me know if this falls within CAMA's jurisdiction. If so, please give advice on the actions required to begin construction. The contract covers the following: Overhead power line along NC 12 APPROVED SUBJECT TO SPECIAL PROVISIONS: 1) The encroaching party shall notify the District Engineer's office [telephone no.(252) 514-4716] prior to beginning construction and upon completion of construction. 2) NCDOT does not guarantee the right of way on this road, nor will it be responsible for any claim for damages brought about by any property owner by reason of this installation. 3) The encroaching party is required to contact the appropriate Utility Companies involved and make satisfactory arrangements to adjust the utilities in conflict with the proposed work prior to beginning construction. 4) The encroaching party shall contact the North Carolina One Call Center at 1-800-632- 4949 and make satisfactory arrangements to adjust the utilities in conflict with the proposed work prior to construction 5) The Contractor shall not begin the construction until after the traffic control and erosion control devices have been installed to the satisfaction of the District Engineer. The Contractor shall comply with all OSHA requirements and provide a competent person on site to supervise excavation at all times. 7) All fill areas/backfill shall be compacted to 95% density in accordance with AASHTO T99 as modified by the NCDOT. All material to a depth of 8 inches below the finished surface of the subgrade shall be compacted to a density equal to 100% of that obtained by compacting a sample of the material in accordance with AASHTO T99 as modified by the Department. The Contractor shall dry or add moisture to the subgrade when required to provide a uniformly compacted and acceptable subgrade. All material placed in a maximum of 6" lifts. 8) All earth areas disturbed shall be graded, dressed, seeded, mulched, and tacked with liquid asphalt or other approved means within 10 days of completion of work in any area. 9) All erosion control devices and measures shall be constructed, installed, maintained, and removed by the Encroacher in accordance with all applicable Federal, State, and local laws, regulations, ordinances, and policies. All earth areas disturbed shall be re- graded, and seeded in accordance with NCDOT Standards and Specifications. 10) All workmanship and materials shall conform to North Carolina Department of Transportation Standards and Specifications manual. 11) The encroaching party shall comply with all applicable federal, state and local environmental regulations, and shall obtain all necessary federal, state and local environmental permits, including but not limited to, those related to sediment control, storm water, wetland, streams, endangered species and historical sites. 12) All existing structures, drainage or otherwise, located inside the Right of Way that are affected by this work shall be restored to meet the NC.D.O. T. Standards and Speci 7cations as directed by the District Engineer. 13) Right of Way monuments disturbed during construction shall be referenced by a State of North Carolina Registered Land Surveyor and reset after construction. 14) Traffic Control Devices shall be in accordance with the manual on Uniform Traffic Control Devices and amendments or supplements thereto. 15) Two way traffic shall be maintained at all times. 16) Any work requiring equipment or personnel within 5 feet of the edge of the travel lane shall require a lane closure with appropriate tapers. F JAN 3 1 Z005 Morehead City DAM Encroachment Agreement 16-04-53 Page 3 17) During non -working hours, equipment shall be parked as close to right of way lines as possible and be properly barricaded in order to not have any equipment obstruction within the Clear Recovery Area. 18) All roadway signs that are removed due to construction shall be reinstalled as soon as possible. 19) Excavation material shall not be placed on pavement. Drainage structures shall not be blocked with excavation materials. 20) All soils located inside the Right of Way shall be considered a type "C" soil. All trenching, shoring and excavation shall follow the OSHA guidelines for this type of soil. 21) All utilities shall be placed in accordance with the manual on Policies and Procedures for Accommodating Utilities on the Highway Rights of Way. 22) Minimum vertical clearance shall be 18 feet for aerial crossings over NCDOT roadways and 15'-6" for longitudinal parallel installations. 23) Proper grading to facilitate drainage shall be done at the end of each day's activities 24) An executed copy of this encroachment agreement, contract, and plans shall be present at the construction site at all times during construction. I have no opposition to the replacement of the current power poles along the existing alignment. Placement of power poles along a different alignment, such as in the marsh, is not desirable for a number of reAgons. First, any placement of poles outside the current easement requires an amendment to the existing easement_ Approval to amend an easement is made at our regional office in Atlanta, GA and would take at least one year to complete, as a legal survey, an appraisal, and a compatibility determination must be completed before the Service's realty division can finalize a new easement. Second, short term and long term effects due to construction and future maintenance activities in the marsh must be fully understood and evaluated. The marsh at Cedar Island National Wildlife Refuge is one of the largest and least disturbed marshes on the entire east coast of the United States and harbors a number of rare species including black rail and seaside sparrow, which breed in the marsh. One important post construction concern is the possible introduction of phragr ices, which is an aggressive exotic plant. This plant is currently uncommon on the Refuge, however, if construction activities kill native vegetation and/or create exposed soil, phragmites may gain a foothold in the marsh, and once established, quickly replace native plants and alter habitat for sensitive wildlife species. Third, both prescribed fires and wildfires, occur in the marsh. Power poles in the marsh are a management concern for prescribed fires and would be much more vulnerable to wildfires than they would be in the current easement location, as they would be surrounded by highly flan -amble fuels and farther from the road where fire personnel would be located.
