Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Mr. Lane:
Enclosed is a copy of an Adjacent Riparian Property Owner Statement which was sent to
me on 1/30/06 and a copy of my 2/6/06 reply. I received a telephone call from a Mr. Nick
D'Ambrosia of Innerbanks Marine Construction on the evening of the 6". During our
conversation, Mr. D'Ambrosia informed me that the Statement form was merely a "courtesy" and
that my signature was not necessary. He further indicated that you had been at the site and that
the pier/dock construction had been approved by you. He did tell me that the proposed concrete
pier would extend five (5) feet into the creek and then run about twenty (20) feet parallel to the
shore and that all work would be done from a barge in the creek. When I asked him where on lot
#15 the pier/dock would be located relative to the pier on the shore opposite to lot #15, he said
that he couldn't tell me since he had not been to the site.
After my conversation with Mr. D'Ambrosia, I called my friend and neighbor, Chuck
Seymour. I could not quite figure out why Innerbanks Marine Construction had gone to the
trouble and expense of sending me a waiver statement by registered mail merely as a "courtesy".
Chuck's conversation with you yesterday has prompted this letter to you.
I remain concerned about the placement and size of the proposed construction because of
the discrepancy between the width of the creek as indicated on the waiver statement versus what
Chuck and I actually measured. To me, it is highly conceivable that a new construction with a
boat docked bank -parallel might impede my access through the creek, particularly if owners of
the opposite lot, which already has a pier on it, decide to develop that property and bring in a boat
and/or a float. The navigable channel through the creek is often extremely narrow.
I would greatly appreciate it if, when you are next in the Oriental area, you could look at
the site with me, so that I can actually show you the source of my concerns and that you might be
able to explain to me what is going on.

Dear Sirs:
Please be advised that I have several concerns relating to the proposed
development as outlined on the Adjacent Riparian Property Owner Statement which I
received on January 301h
I believe that the drawing, which shows the creek width as 70 feet, is incorrect.
As measured by a friend and me on Wednesday, February Is', the true width
approximately midway on lot #15 is 40 feet Mean High Water. Not shown on the
drawing are the pier and piling on the opposite bank. The true distance from the MHW
mark on lot #15 to the end of that pier is 29 feet. Any construction must take into
account the location and clearance of that structure.
In view of the above, I request a detailed drawing showing the exact location,
measurements and materials to be used in the construction of the requested pier and that
the drawing/document be notarized to ensure compliance.
