Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . Ross Jr., Secretary October 3, 2005 Mr. and Mrs. Sheppard 4412 Winona Trail Suffolk, VA 23434 Re: Objection to the Issuance of CAMA General Permit No. 42591-A Development Project, Location, Perquimans County Dear Mr. and Mrs. Sheppard: This letter is in response to your objection as an adjacent riparian property owner to a permit request from Robert Brinson, for the construction of a vinyl bulkhead and pier at 164 River Moss Way, Perquimans County. Kimberly Hedrick, of the Division of Coastal Management staff, was recently on site to evaluate the permit applicant's request. The permit applicant has requested a permit to construct 205 linear feet of bulkhead and a pier extending 60 feet long by 5 feet wide to a 100 sq. ft. platform in Yeopim River. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H .1100 (bulkhead) and 07H.1200 (pier). You have notified the Division of Coastal Management of your objections to this proposed development by faxing a letter, dated September 22, 2005, concerning the proximity of Mr. Brinson's pier to your riparian property line and obstruction of navigation from the construction of his pier. Kimberly Hedrick has reviewed your objection, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. On September 21, 2005, the contractor, Mr. Brinson, and Kimberly Hedrick measured the distance from your riparian property line to the proposed location of Mr. Brinson's pier to be approximately 95 feet, not 25-ft indicated in his drawing. The above referenced Subchapters allow for structures, as described above, to be built over the waters of Yeopim River, provided that the permit applicant meets and complies with all of the application prerequisite conditions. This includes the construction of a pier with a platform, provided that they comply with the specific conditions of Subchapter 07H.1200. The proposed pier structure will have a 100 square ft. platform, while these rules specifically allow for 400 square feet of platform. The proposed pier structure will extend 70 ft. in length into Yeopim River and 5-ft. wide. The pier structure will also exceed the 15-ft. setback requirement by being set back nearly 95 feet from your property line. Also included is the construction of a bulkhead, provided that they comply with the specific conditions of Subchapter 07H.1100. The proposed vinyl bulkhead will be a total of 205 linear feet, while these rules allow for 500 linear feet of bulkhead. After having given careful consideration to your objection to this proposed development, we have determined that it is consistent with the Rules of the CRC and the State's Coastal Management Program, and that all pre -requisites have been satisfied. Therefore, the Division of Coastal Management issued General Permit No. 42591-A on October 3, 2005 (copy attached) for the proposed development. If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the Division of Coastal Management within 20 days of the permit issuance date. If you choose to pursue an appeal, please contact this office so that we can provide you with the appropriate forms and addresses.
